You have not addressed the issue of all of the damage that your electrician caused to my drywall and I am in the process of obtaining estimates to replace and repair the same since it appears you have abandoned the job. You have left a portable toilet on the property and, if the same is accruing charges for use or storage, I plan to hold you responsible for the same. Please address this with the company at once. Your workers caused significant damage to an oven that they removed from my kitchen and brought to the garage. It appears that because of the way they handled it, or the way in which they placed it, they have broken the front door off it. I expect you to reimburse me for this. I am in the process of hiring a building /construction inspector to evaluate the work and performance of your company and subcontractors. I will also have this individual evaluate the damage that you have done to my home and the extreme delay that your failure of performance and job abandonment has cost. To date you have not replied to any my letters regarding the construction delay and breach of contract. Insurance: Pursuant to our Standard Form of Agreement Between Owner and Contractor, AIA document A101 -1997 (Contract), Amendment 4: Contractor is mandated to carry both worker's compensation insurance and general liability insurance of at least $500,000 combined single limits throughout the pendency of construction services at the subject property. This is an essential term of the contract. That further, Contractor agrees to provide evidence of these coverages to Owner at commencement of construction and, Owner is to be included as an additional insured on the General Liability policy. The agent or broker providing coverage must be mandated by Contractor, in writing, to notify Owner if either policy of insurance should lapse, become suspended, revoked or canceled for any reason during the pendency of the construction project. It appears that the insurance coverage information that you provided at the start of the contract for worker's compensation expired on 4/11/06 and for General Liability on 5/14/06. Unless you provide evidence that these coverages were renewed, naming Jeffrey and Yasmin Davis, as Owner, as additional insureds, you are in material breach of contract. Please furnish evidence of this insurance forthwith. 2. Protection of Property and Security: Since the beginning of the project, I have repeatedly requested that you protect, cover and secure the existing property at the house from damage and theft. It became apparent that the house was being used by -kids and /or vagrants after a series of break -ins occurred which included damage to doors, appliances and theft of tools. I made several police reports and advised you of these instances. I requested that you fence the property and secure it carefully at night. You made a half - hearted attempt at placing some plastic fencing on the side which lasted a few days. Further, I have requested countless times, both • • • • • • in writing and in person, that your workers and subs protect my existing windows, doors and floors. The only apparent efforts you have made in this regard was removal of some carpeting from the bedroom to cover the wooden floor of the adjoining bedroom and some placement of film on several of the windows. Unfortunately, the windows and doors were not properly covered and protected and the wooden floors were never properly covered. As a result, my existing doors and windows have been scratched, chipped and have broken handles. Further, you failed to remove the screens on the existing windows and doors and nearly all of them have been ripped, bent and damaged. The wooden floors on the second level of house, especially in the master bedroom are scratched and stained due to the absence of any protection and now require complete refinishing. Accordingly, I request that you immediately clean and cover all of the windows and doors, including their frames, on the inside and out to prevent further damage. I would urge you to immediately contact Jim at your window supplier (R & S Companies) to meet at the house to order the parts necessary to replace the broken screens and repair the damaged handles on the doors. Further, it appears that you have failed to order two replacement windows that your employees damaged during installation. You had assured me that you had ordered them, but as of today's date, in a telephone conversation with Jim at R & S Windows, I learned that you did not. Protection of my existing property and windows and doors, including the frames, is essential. The sliding glass door thresholds should be covered when the workers are entering and exiting the house so as to avoid scratching the frames and bending the thresholds by dragging heavy materials and wheelbarrows over the same. This too is not being done. I urge you to correct these problems forthwith to prevent additional damage. I expect the damage to be repaired and / or fixed. 3. Site Conditions: Since the beginning of this job, you and I have had a constant tug of war over the , condition that your crew was leaving the property. This is unacceptable. Additionally, inside the house, there are boards with nails protruding from them, holes that are uncovered in the floor and numerous other unsafe conditions. I have repeatedly requested that you keep the job site clean so as to avoid injury and damage to property and building materials. As of yesterday, I noted that there are piles of garbage and building materials located at each and every portion of this job which presents both a safety hazard and eyesore. It is impossible for workers to enter and exit the house without confronting hunks of concrete with rusty rebar protruding from it, splintered wood with rusty nails and loose pipes, wire and other debris. This job site is unsafe and I demand that you clean it and keep it in a reasonably safe and clean state for the remainder of the job. 4. Plumbing: As you know, the rough plumbing was completed last week. For months you have advised me that you had no contact from the plumber and that he was avoiding your calls and not appearing for work. My wife and I have met with and spoke with the plumbers directly and have learned that this is simply not the case. After making an initial deposit to them early on, you continued to advise them that you were unable to secure a commitment from the owner regarding the piping under the house. This is despite the fact that you were paid 50% of this plumbing extra back in April. This misrepresentation by you delayed the job three months since the plumber could not complete his work and, you continually deferred paying him for your own reasons. This unacceptable. As a result, I have paid the plumber directly for the remainder of his rough and for the. entire underground piping. I do not believe that you are entitled to take any percentage of the underground work (extra) since your misrepresentations delayed the job and forced me to incur thousands of dollars in extra rent and storage charges. Window and Door Installation: I have been advised by an architect that proper window installation is done by using a laser in order to ensure that each window is at the same height from the floor. I have noticed and advised you that at least one of the windows you installed is crooked. Worse still, you have failed to properly install the windows such that water has been entering the house each and every time it rains. This has resulted in the destruction (and resultant removal) of an existing ceiling and the growth of mold and mildew on interior walls. I asked you to replace furring strips that were covered with black mold and you replied that you would. Subsequently I have observed containers of bleach in the house indicating that cleaning attempts are being made (and not replacement). Putting insulation and sheetrock over moldy furring strips is an invitation to disaster and will result in a mold problem in the house. I urge you to remove any /all wet and moldy wood and promptly correct the waterproofing issue. Additionally, despite my wife and the architect clearly explaining the type of sliding glass doors we needed, the wrong doors were ordered. Worse still, the wrong doors were installed. Now we need to have you remove the new sliding glass doors and take them back to R & 5 Windows for their correction. Jim at R & S Windows has advised me that he has all the parts needed and awaits your delivery of the doors. This too is taking an extraordinarily long time for no apparent reason. Also, I have asked you to address the issue of the upstairs, master bedroom door opening from the center and not on the left hand side. You assured me that you would address this, but to date have not done so. As you know, as the present configuration exists in the master bedroom, I will not be able to enter the balcony. Please also note that due to your failure to protect the existing door leading from the kitchen to the pool deck, it was damaged and cost me over ', :00 to replace it. Although I purchased the house well over a year ago, I am still going through the approval process in order to obtain all necessary building permits so as to remodel the house. One of the improvements I made was to add a new dock and boat lift. Unfortunately, my neighbor to the south, Robert G. Laney, decided to purchase a 29 foot Sea Ray motor boat which he failed to properly secure during Hurricane Katrina. The boat sunk behind my house and Mr. Laney elected to abandon it there. Despite my multiple requests that he remove the sunken boat from behind my home, Mr. Laney advised that it would be too expensive (approximately $4,000.00), so he just left it there. When Hurricane Wilma was approaching, Mr. Laney, without my permission, decided to secure his sunken vessel to my new dock. The storm caused the sunken vessel to literally tear my new dock and boat lift to pieces thereby destroying the same. The boat has broken up into several large pieces which are now lodged under my dock and behind my property. Despite my multiple in- person requests, telephonic requests and written requests, Mr. Laney has simply ignored me and done absolutely nothing to resolve this problem that he has created. Further, he has ignored the efforts of the Florida Fish Sr Wildlife Commission who have issued him a summons to appear in court. I have notified the Coast Guard and D.E.R.M. about this situation but both claim that their organizations do not have jurisdiction. I have sued Mr. Laney in Miami -Dade County Circuit Court, but he has ignored the lawsuit and a default has been entered against him. We are proceeding to trial where I will likely obtain a judgment for damages against him. In speaking with my dock builder, Dock & Marine Construction, I have been advised that, in the past, The Village of Miami Shores has hired this company to remove debris from the Bay and canals when the same pose a nuisance or hazard. Mr. Laney's abandoned vessel not only poses a hazard by polluting our Bay, but it also prevents me from being able to repair my dock and boat lift. Does The Village of Miami Shores have the ability to contract with a private salvage company, such as Dock & Marine Construction (or any company for that matter) in order to correct this problem and remove the abandoned vessel and its debris field? Since a resident of Miami Shores created this problem, could The Village not order him to correct it within a certain time frame and, if he failed to comply, correct it for him and lien his house or otherwise fine him? By way of analogy, if Mr. Laney decided to abandon a vehicle or other junk on my property, could The Village not order him to remove it due to the unsightly hazard it created? If in fact he refused to comply with The Village's orders, could The Village not correct the problem for Mr. Laney and then fine him?
