As per our engineer, the code stablish that no cap tile in steps and swimmout is required if the depth of pool is it less than 6 feet. As we talked yesterday at Mr. Trivone's job, where you looked at the Florida Building Code book, residential pools are not mentined in the cap tile section. Today I bought the ANSI Book and it does not say anything about cap tiles on steps and benches. I do not know if this is enough for you to approve this revision, anyways, I will keep investigating about it.
