A RESOLUTION VACATING THE DEDICATED ALLEY ON THE NORTH
SIDE OF LOTS 13 AND 15 OF BLOCK 6, AS DESCRIBED IN THE
REPLAT OF TRACT "C" , MIAMI SHORES BAY PARK ESTATES,
RECORDED IN PLAT BOOK 64, PAGE 97, OF THE PUBLIC RECORDS
OF DADE COUNTY, FLORIDA; RESERVING EASEMENT FOR EXISTING
UTILITIES IN PLACE IN SAID ALLEY; PROVIDING EFFECTIVE
DATE.
WHEREAS, Albert R. Toussaint and Nancy Toussaint,
his wife, and James Wiborg and Lorrie Wiborg, his wife, being
the owners of Lots 13 and 15, respectively, of Block 6, of
the Replat of Tract "C" , of Miami Shores Bay Park Estates,
as recorded in Plat Book 64, at page 97, of the Public Records
in and for Dade County, Florida, have petitioned the Miami
Shores Village Council to vacate the designated alley des-
cribed on the north side of the aforesaid lots and appearing
in the aforementioned plat, and
WHEREAS, said petition to vacate said alley was
heretofore considered and approved by the Planning and Zoning
Board of Miami Shores Village on August 27, 1987, and
WHEREAS, that said alley has never been paved or
used by the public is an indication that said alley does not
in any way benefit the public or the abutting property owners,
and
WHEREAS, it appearing that the petitioners are entitled
to the relief requested,
NOW, THEREFORE, BE IT RESOLVED that that portion of
the alley appearing on the plat of Lots 13 and 15, Block 6,
Replat of Tract "C" , MIAMI SHORES BAY PARK ESTATES, as recorded
in Plat Book 64, page 97, of the Public Records of Dade County,
Florida, is hereby vacated and abandoned, and Miami Shores
Village does hereby disclaim all of the right, title and interest
of Miami Shores Village in and to said alley, provided, never-
theless, that this resolution shall in no manner affect the
right of easement in and to said alley for any public utility
erected or situated therein on the date of the adoption of
this resolution.
This resolution shall become effective upon its
adoption.
