R-0704-81 RESOLUTION NO. 704-81 A RESOLUTION TO THE BOARD OF COUNTY COMMISSIONERS OBJECTING TO THE COUNTY ORDINANCE ON CODE ENFORCEMENT BOARDS. WHEREAS, Miami Shores Village has established a local Code Enforcement Board pursuant to the laws of Florida; and WHEREAS, the Dade County Board of County Commissioners have passed first reading of an ordinance which would in effect abolish local Code Enforcement Boards; and WHEREAS, the County ordinance exempting Dade County from Chapter 80-300 is a public policy statement by the Board of County Commissioners that they wish to assume responsibility for the enforcement of the higher standards of zoning, service, and regulations, established by municipalities; and WHEREAS, such assumption by Dade County for the enforcement of these higher standards is contrary to County and State policy heretofore established, in that it specifically conflicts with the Dade County Charter, Article V, Section 5. 02, as well as the intent of the Comprehensive Planning Act; and WHEREAS, the Village does not feel it is the County' s intent to deprive the County residents living in municipalities from the higher zoning standards, service, and regulations, but rather to protect these residents from inconsistent interpretation of already established Countywide ordinances, such as, the South Florida Building Code; and WHEREAS, the existing Court systems and administrative procedures are not sufficient to provide for the enforcement of higher standards of zoning, service, and regulations, as provided for in the Dade County Charter; NOW, THEREFORE, BE IT RESOLVED: Section 1. That Dade County amend the proposed County ordinance exempting Dade County from the provisions of Chapter 80-300, to provide for the exemption of only those Countywide ordinances which have been or may be adopted by Dade County, such as, . the South Florida Building Code and certain environmental regulations. Section 2. That Dade County reaffirm its support for the establishment and enforcement by municipalities of higher standards of zoning, service, and regulations. Section 3. That Dade County specifically authorize municipalities to provide for local Code Enforcement Boards to enforce those higher standards of zoning, service, and regulations, as provided for in the Dade County Charter, Section 5. 02.
