R-0615-76 RESOLUTION N0. 615 A RESOLUTION ADOPTING RULES OF ORDER AND PROCEDURE OF THE VILLAGE COUNCIL OF MIAMI SHORES; DESIGNATING TIME AND PLACE FOR REGULAR MEETINGS THEREOF; AUTHOR- IZING SPECIAL MEETINGS AND PROVIDING FOR MEANS TO SUSPEND RULES OF ORDER. BE IT RESOLVED BY MIAMI SHORES VILLAGE: Section 1. There exists a need to fix rules of order and procedure governing the meetings of the Miami Shores Village Council in order to promote order and efficiency in the conduct of Council business. Section 2. That for the purposes hereinabove stated, all meetings of the Miami Shores Village Council, either regular or special, shall be governed by the following rules. MEETINGS OF COUNCIL 1. At the first meeting after each election, as provided for in the Miami Shores Village Charter, the Council shall elect one of its members to serve as Mayor and another member to serve as Acting Mayor, who shall serve in the absence of the Mayor. The Acting Mayor shall, in the absence of the Mayor, perform the duties of the Mayor. 2. With the above exception, the Village Council shall meet regularly on the first and third Tuesdays of each month at the hour of 7:30 o' clock p.m. in the Council Chamber at the Miami Shores Village Hall. 3. The Council may, by a majority vote, adjourn any meet- ing in order to reconvene at another Village owned building for the purpose of conducting a meeting requiring a greater seating capacity. 4. All meetings of the Council shall be open to the public, and notice of said meeting shall be posted at the Village Hall and may be advertised in a paper of general circulation serving Miami Shores Village. 5. Special meetings or work sessions may be held on the call of two or more Council members. Calling of special meet- ings or work sessions shall be by twelve (12) hours advance notice of said meetings, which notice shall be made orally, by mail, or by written notice left at the residence of Council members. 6. As soon after the hour of meeting as there shall be a quorum present, the presiding officer shall call the meeting to order. A quorum shall be comprised of not less than three (3) Council members. 7 . If there is no quorum present within one hour after the time fixed for any meeting, said meeting shall stand adjourned. 8. Upon calling the meeting to order, the presiding officer shall call for the invocation, to be followed by the pledge of allegiance to the flag. 9. The first order of business shall be the reading of the minutes of the next preceding meeting in order to correct errors or omissions, and, upon approval thereof, same shall be signed by the presiding officer. The minutes as presented may be approved by a unanimous vote without the reading thereof. 10. By a unanimous vote, the Council may consider any subject out of order. 11. The presiding officer shall preserve order at all meetings. 12. If the Mayor decides to vacate the chair for any purpose, the Acting Mayor shall thereupon preside. In the event the Acting Mayor desires to vacate the chair, he shall appoint another Councilman to preside in his absence. 13. Any person, including members of the Council, desiring to speak for any purpose shall first be recognized by the Chair. 14. When two or more members of the Council address the - 2 - Chair to speak, the Mayor shall first recognize the member of the Council who, in his opinion, first addressed the Chair. 15. The presiding officer shall assure that every member present in the Council Chamber shall vote on every motion, unless the Council shall have excused that member, because he is per- sonally involved in the question. 16. Any member of the public wishing to be heard shall stand, upon being recognized by the Chair, state his or her name and address for the record, and address the statement or question to the Chair. The presiding officer may answer said question, or, in the alternate, may determine which Council member desires to answer same. No person shall interrupt another while speaking if the speaker has been duly recognized by the Chair. A Council member recognized by the Chair has the floor until he relinquishes the same. 17. Any Council member, upon recognition by the Chair, may request the question or motion under discussion to be read at any time during debate. 18. Any one or more of these rules may be temporarily suspended by a vote of the majority of Council members present at a duly constituted meeting. 19. These rules shall prevail in the event of a conflict between these rules and Robert' s Rules of Order. 4 Section 3. This resolution to be effective immediately upon adoption.
