RESOLUTION CALLING SPECIAL ELECTION IN MIAMI
SHORES VILLAGE, FLORIDA, ON TUESDAY
MARCH 9, 1976, FOR THE PURPOSE OF SUBMITTING
TO THE ELECTORS OF MIAMI SHORES VILLAGE PROPOSALS
FOR AMENDMENTS TO MIAMI SHORES VILLAGE CHARTER AS
FOLLOWS: SECTION 22 (PROVIDING FOR MAXIMUM OF 8
CONSECUTIVE YEARS AS COUNCILMAN) ; SECTION 24
(REQUIRING PETITIONS FOR NOMINATION OF COUNCILMAN
TO BE FILED WITH VILLAGE CLERK AT LEAST 30 DAYS
PRIOR TO ELECTION DATE AND VERIFICATION OF
PETITIONS BY CLERK WITHIN 10 DAYS AFTER FILING) ;
SECTION 26 (REQUIRING A MINIMUM OF 3 AFFIRMATIVE
VOTES OF COUNCIL ON ALL MATTERS) ; SECTION 30
(ELIMINATING THE AUTHORITY OF COUNCIL TO APPOINT
CHIEFS OF POLICE AND FIRE) ; SECTION 34 (PRO-
VIDING FOR APPOINTMENT OF AN ACTING VILLAGE
MANAGER) ; ALL OF ARTICLE III AS CODIFIED
WHEREAS, pursuant to Section 5.03 of the Home Rule
Amendment of Metropolitan Dade County, Florida, the following
charter amendments were proposed; and
WHEREAS, the Council of Miami Shores Village believes
that the resident voters of Miami Shores Village should have the
right to approve and/or disapprove the same and said Council is
authorized, pursuant to ordinance, to propose said charter
amendments by resolution and to call elections on such proposed
charter amendments;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MIAMI
SHORES VILLAGE, FLORIDA:
Section 1. In accordance with the provisions of
Section 5.03 of the Home Rule Amendment and Charter of
Metropolitan Dade County, Florida,and the Charter of Miami Shores
Village, Florida, a special election is hereby called and shall
be held in Miami Shores Village, Tuesday, March 9, 1976, for the
purpose of submitting to the qualified electors of Miami Shores
Village, Florida, proposals for amendments to the Miami Shores
Village Charter in the forms attached hereto and made a part
hereof.
Section 2. Notice of such special election shall be
published in a newspaper of general circulation in Miami Shores

Village, Florida, once a week for four consecutive weeks, the date
of first publication to be at least thirty (30) days prior to the
date of said special election, by publishing this resolution in
full, or as otherwise authorized by law, which shall constitute
notice of such special election.
Section 3. The result of such special election shall be
determined by a majority of the qualified electors of Miami Shores
Village, Florida, voting upon each proposed charter amendment in
accordance with the provisions of the general election laws.
Voting machines shall be used in such special election, and the
questions which shall appear on the voting machines shall be
substantially in the following form:

SHALL SECTION 22 OF THE CHARTER BE
AMENDED TO PROVIDE A MAXCMUM OF EIGHT
(8) CONSECUTIVE YEARS AS COUNCILMAN?
PROPOSED CHARTER AMENDMENT NO. 2
SHALL SECTION 24 OF THE CHARTER BE
AMENDED TO REQUIRE PETITIONS FOR
NOKINATION OF COUNCILMAN TO BE FILED
WITH THE VILLAGE CLERK NOT LESS THAN
THIRTY (30) DAYS PRIOR TO THE ELECTION
DATE AND TO REQUIRE THE CLERK, WITHIN
TEN (10) DAYS AFTER FILING OF THE
PETITION, TO NOTIFY THE CANDIDATE AND
PERSON FILING THE PETITION WHETHER OR
NOT IT IS FOUND TO BE SIGNED BY THE
REQUIRED NUMBER OF PERSONS?
PROPOSED CHARTER AMENDMENT NO. 3
SHALL SECTION 26 OF THE CHARTER BE
AMENDED TO REQUIRE A MINIMUM OF THREE (3)
AFFIRMATIVE VOTES OF THE COUNCIL ON ALL
MATTERS?
PROPOSED CHARTER AMENDMENT NO. 4
SHALL SECTION 30 OF THE CHARTER BE
AMENDED TO ELIMINATE THE PRESENT
AUTHORITY OF THE COUNCIL TO APPOINT
CHIEFS OF POLICE AND FIRE?
PROPOSED CHARTER AMENDMENT NO. 5
SHALL SECTION 34 OF THE CHARTER BE
AMENDED TO PROVIDE FOR THE APPOINTMENT
OF AN ACTING VILLAGE MANAGER BY THE
VILLAGE MANAGER WITH THE APPROVAL OF
THE COUNCIL AND REPLACEMENT OF SUCH
ACTING MANAGER BY THE COUNCIL?

Section 4. Such proposed charter amendments shall
appear on the voting machine ballot as a separate question or
proposal. Those qualified electors desiring to approve such
amendment shall be instructed to pull down the lever over or
opposite the words "FOR PROPOSED CHARTER AMENDMENT" and those
qualified electors desiring to reject such proposed charter
amendment shall be instructed to pull down the lever over or
opposite the words "AGAINST PROPOSED CHARTER AMENDKENT. 11
Section 5. Absentee paper ballots may be used by
any qualified elector of Miami Shores Village for voting on the
proposed charter amendments in accordance with the laws of the
State of Florida.
Section 6. A sample ballot showing the manner in
which the question or proposal aforesaid will appear on the voting
machines at this special election shall be published and provided
in accordance with the applicable provisions of the general
election laws.
Section 7. This special election on proposed charter
amendments aforesaid shall be held and conducted in accordance
with the applicable provisions of the general laws relating to
special elections, provisions of the Metropolitan. Dade County
Home Rule Amendment . and Charter. All officials involved in said
proceedings are hereby authorized and directed to take appropriate
action necessary to carry into effect and accomplish the provisions
of this Rksolution. Election Inspection Boards, inspectors
and clerks to serve as election officials shall be appointed in
accordance with the provisions of the general election laws, and
this special election shall be canvassed in accordance with the
laws provided therefor.
