RESOLUTION APPROVING PROPOSED AMENDMENT
TO ARTICLE III, SECTION 24, OF MIAMI
SHORES VILLAGE CHARTER, REQUIRING
PETITIONS FOR. NOMINATION OF COUNCILMAN
TO BE FILED WITH THE VILLAGE CLERK AT
LEAST 30 DAYS PRIOR. TO ELECTION DATE AND
VERIFICATION OF PETITIONS BY CLERK WITHIN
10 DAYS AFTER FILING
WHEREAS, the Council of Miami Shores Village believes
that the resident voters of Miami Shores Village should have the
right to determine whether or not they wish to require petitions
for nomination for the Council to be filed with the Village
Clerk not less than thirty (30) days prior to the election date
and to require the Clerk, within ten (10) days after the filing
of a nominating petition, to notify the candidate and person
filing the petition whether or not it is found to be signed by
the required number of persons;
NOW, THEREFORE, BE IT RESOLVED by the Council of
Miami Shores Village that this Council hereby approves the
proposed amendment to Article III, Section 24, of the Miami
Shores Village Charter, attached hereto, so as to require
petitions for nomination for the Council to be filed with the
Village Clerk not less than thirty (30) days prior to the
election date and to require the Clerk, within ten (10) days
after the filing of a nominating petition, to notify the
candidate and person filing the petition whether or not it is
found to be signed by the required number of persons.

PROPOSED AMENDMENT TO
ARTICLE III, SECTION 241
OF THE MIAMI SHORES
VILLAGE CHARTER
Article III, Section 24, Nomination of Councilman
Effective January 1, 1977, any qualified elector and free-
holder of the Village may be nominated for the Council by
petition. A petition for this purpose shall be signed by not less
than 50 qualified electors and filed with the Village Clerk not
less than twenty thirty days prior to the election date. No
elector shall sign more than three such petitions, and should an
elector do so, his signature shall be void except as to the petition
first filed. The signatures on the nominating petition need not
all be subscribed to one paper, but to each separate paper there
shall be attached a signed statement of the circulator thereof,
stating the number of signers of such paper and that each signature
appended thereto was made in his presence and is the genuine signa-
ture of the person whose name it purports to be. With each
signature, including the signature of the circulator, shall be
stated the place of residence of the signer, giving the street and
number or other description sufficient to identify it. The form
of the nominating petition shall be substantially as follows:
"We, the undersigned electors of Miami Shores Village, hereby
nominate for the office of
Councilman.
Name Street and Number Address from which last registered (if
different) Date of Signing.

Statement of Circulator
The undersigned is the circulator of the foregoing paper containing
signatures. E ch signature appended thereto was
made in my presence and is the genuine signature of the person
whose name it purports to be.

Acceptance of Nomination
I hereby accept the nomination for the Council and agree to serve
if elected.
Signature of Candidate if
Within give ten days after the filing of a nominating petition
the Village Clerk shall notify the candidate and the person who
filed the petition whether or not it is found to be signed by the
required number of qualified electors. If a petition is found
insufficient, the Village Clerk shall return it immediately to the
person who filed it with a statement certifying wherein the petition
is found insufficient. Within the regular time for filing petitions
such a petition may be amended and filed again as a new petition or
a different petition may be filed for the same candidate. Such
petitions shall be preserved by the Village Clerk until the results
of the election in which such person so nominated is voted upon are
canvassed whereupon the petitions shall be destroyed.
