RESCLUTION NO. 589
A RESOLUTION DISCONTINUING, VACATING,
AND CLOSING A PORTION OF THE ALLEY
LYING BETWEEN LOT 27, BLOCK 67,
MIAMI SHORES SECTION 3 (PLAT BOOK 10,
PAGE 37) ;AND LOT 28, BLOCK 67,
MIAMI SHORES SECTION 3 (PLAT BOOK 10,
PAGE 37) AND LOT 3, BLOCK 1, JONI
HEIGHTS (PLAT BOOK 96, PAGE 23) AS
RECORDED IN THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, RESERVING UNTO THE
VILLAGE OF MIAMI SHORES THE RIGHT TO
MAINTAIN AND INSTALL PUBLIC UTILITIES
WHEREAS, request has been made to close a portion of
the alley hereinafter described, reserving, however, unto the
Village the right to install and maintain public utilities
therein; and
WHEREAS, it appears that vacation of said portion of
said alley, subject to such reservation, is in the public
interest,
NOW, THEREFORE, BE IT RESOLVED BY MIAMI SHORES VILLAGE,
subject to the reservations hereinafter set forth:
That the following described portion of an alley
lying and being in Miami Shores Village, to-wit:
that portion of a fifteen (15) foot wide alley
lying between Lot 27, Block 67, Miami Shores
Section 3, Plat Book 10, Page 37, and Lot 28,
Block 67, Miami Shores Section 3, Plat Book 10,
Page 37, and Lot 3, Block 1, Joni Heights, Plat
Book 96, Page 23; and lying Northerly of the
Northerly Right of Way line of NE 94th Street
and Southerly of a line 112.85 feet North of and
parallel to the Northerly Right of Way line of
NE 94th Street, more particularly described as
follows:
Beginning at the Southeast corner of Lot 27,
Block 67 of Miami Shores Section 3, as recorded
in Plat Book 10, at Page 37, of the Public
Records of Dade County, Florida; thence run East
along the Northerly Right of Way line of NE 94th
Street for a distance of 15.00 feet; thence run
North along a line 15.00 feet East of and parallel
to the Easterly boundary of Lot 27 for a distance
of 112.85 feet; thence run West along a line
parallel to and 112.85 feet North of the Northerly
Right of Way line of NE 94th Street a distance of
15.00 feet to a point on the Easterly boundary of
said Lot 27; thence run South along the East
boundary of Lot 27 for a distance of 112.85 feet
to the Point of Beginning,
Reserving, however, the right of Miami Shores
Village to install, maintain, operate, repair, and
replace by itself, or any licensee or holder of a

franchise from the Village, any poles, wires,
pipes, conduits, sewer mains, water mains,
gas mains, or any facility or equipment for
the maintenance or operation of any utility,
now or hereafter located in the portion of
the alley vacated by this resolution, which
rights are specifically retained,
be and the same is hereby discontinued, vacated, and closed.
