R-380-58 o RESOLUTION NO. . 380 WHEREAS, Miami Shores Village has agreed to purchase a tract of land known as Block 107, Miami Shores Subdivision, for the use of its Recreation Department; and WHEREAS, the Village is without the full amount of the necessary funds with which to pay for said land which will cost $21, 750. 00; and WHEREAS, Bessemer Properties, Inc. has agreed to lend the Village 9016 of said sum, or $19, 575. 00, re-payable in 15 equal annual installments bearing interest at 4016 per annum, upon the execution and delivery to said company of a Certificate of Indebtedness executed by the Village; NOW, THEREFORE, BE IT RESOLVED BY MIAMI SHORES VILLAGE, that the Village borrow from Bessemer Properties, Inc. the sum of $19, 575. 00 payable in 15 equal annual installments bearing inter- est at 4% per annum, and that the Mayor and Village Clerk execute a Certificate of Indebtedness therefor; BE IT FURTHER RESOLVED that the said Village and its officials shall in no wise be liable for any of the sums of money represented by such Certificate of Indebtedness but the same shall be payable solely from the proceeds derived by the Village from the Florida Power and Light Company pursuant to a franchise agreement dated the 15th day of May, 1951, which amounts to $35, 000. 00 per year, of which the first $11, 000. 00 per year is now pledged, and the taxing power of this Village shall never be exercised for the purpose of raising funds to pay for said Certificate or any part thereof. PASSED AND ADOPTED this lst day of July, 1958. Mayor ATTEuT: Village Clerk r CZRTIFICATIG MIAMI SHORES,VILLAGE does hereby certify that pursuant to Resolution No. 380 adopted by its Council on July 1, 1938, it promises to pay to the order of Bessomer Properties, Incorporated. the sum of Nineteen Thousand Five Hundred Seventy-five Dollars ($19.575.00) with Interest the"oa at 4% per annum, which said suns is payable to said Bessemer Properties, Incorporated,. in annual installments of Thirteen Hundred Five Dollars ($1305.00), the first of said installments being due and payable on duly 1, 1959 and a like sum being due each year thereafter until the whole sum, with interest as aforesaid, is fully paid. Interest on said sum or the balance remaining from time to time shall be paid at the same time the annual installments of the principal are paid. WARNER RING, the Village Council has lost the services of a faithful and devoted citizen who has served as the Accountant for this Village since its organization in 1932; that the Village has lost an un- selfish and distinguished friend, whose disinterested activities have been of great value to the people of this Village and that the citizens thereof have lost a friend and neighbor whose good conduct and patriot- ism will always be an example for others to follow; BE IT FURTHER RESOLVED, that this resolution be spread upon the minutes of the Council and that suitable copies under the hand of the Mayor and Village Clerk be presented to Mr. Ring's family.
