R-318-51 RESOLUTION NO. 318 A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO PURCHASE CERTAIN PROPERTY FOR MIAMI SHORES VILLAGE AND TO EXECUTE A- MORTGAGE AND NOTE FOR THE PAYMENT THEREOF. T+CREAS, it is necessary in the public interest that Northeast 106 Street, as it presently exists in Miami Shores V11- lage, be extended from its present terminus, which is the east line of the Southwest quarter of the Southwest quarter- of Section 321, Township 52 south, Range 42 East, to the center line of Bis- cayne Boulevard, the width of the said street as extended being 50 feet; and WHEREAS, the owner of said land, Sidney D. Ansin, has agreed to sell the said property to the Village for the sum of Ninety-five Hundred Dollars ($9,500.00) , payable Fifteen Hundred Dollars ($1,500.00) in cash at the time of the delivery of the deed, and the balance to be payable at One Thousand Dollars ($1,000.00) per year, with interest at Four Percent (4%) per annum from date, the annual payments to begin one year from the date of the delivery of the deed, and the said balance to be secured by a mortgage upon the above described property; NOTA, THEREFORE, BE IT RESOLVED By Miami Shores Village: Section 1. That it purchase the property hereinafter de- scribed from the said Sidney D. Ansin upon the above terms and con- ditions, said property being described as follows: A portion of Lot 2, Block 2, JULIA D. TUTTLE SUB- DIVISION, according to the Plat thereof, recorded In Plat Book. B, at page 4, of the Public Records of Dade County, Florida, more particularly described as follows: Commence at the Southeast Corner of the Southwest 1/4 of the Southwest 1/4 of Section 32, Township 52S, Range 42E. , run North along the East line of the Said Southwest 1/4 of the Southwest 1/4 of Section 32-52-42, a distance of 566 feet, more or less, to the North line of Northeast 106th Street, as shown on a plat of MIAMI ..SHORES ESTATES, recorded in Plat Book 47, at page. 58, of the Public Records of Dade County, Florida, for the point of beginning; Thence run East along the North line extended of 106th Street, as shown on a plat of MIAMI SHORES ESTATES, according to Plat Book 47, at page 58, of the Public Records of Dade County, Florida, 330.34 feet, more or less, to the center line of Biscayne Boulevard; thence run Southwesterly along the center line of Biscayne Boulevard 64.21 feet, more or less, to the Intersection of the South line extended of N.E. 106th Street, as spawn on a plat of MIAMI SHORES ESTATES, according to Plat Book 47, at page 58, of the Public Records of Dade County, Florida; thence run West 290.04 feet, more or less, to the East line of the Southwest 1/4...:of the Southwest 1/4 of Section 32, Township 52 S. , Range 42 East; thence run North 50 feet to the point of beginning, excepting therefrom the right-of-way of Biscayne Boulevard. BE IT: FURTHER RESOLVED that the Mayor and the Village Clerk be and they are hereby authorized and directed to pay to the said Sidney D. Ansin the said sum of Fifteen Hundred Dollars (01,500.00) in cash out- of any unappropriated funds of the Vil- lage, and that they execute and deliver to the said Sidney D. Ansin a note of Miami Shores Village in the slam of Eight Thousand Dollars ($89000.00) , payable at the rate of One Thousand Dollars ($1,000.00) per year, beginning on the first year after the date of the delivery of, said note, with the right on the part of the Village to pay all, or any part, of the principal at any time prior to maturity, with interest on the balance remaining from time to time unpaid at four percent (4%) from date. BE IT. FURTBER RESOLVED that the Mayor and Village Clerk' be and they are authorized to execute on behalf of Miami Shores Village a mortgage in favor of the said Ansin, securing the pay- ment of said note and encumbering the property described in the first paragraph of this resolution. BE IT FURTHER RESOLVED that the purchase of said property Is necessary in the public interest and that the full faith and credit of said municipality be pledged in payment of the purchase price of said property.
