A RESOLUTION CALLING AN ELECTION TO
APPROVE OR DISAPPROVE A GOLF COURT
` IN THE VILLAGE, AND THE MHTHIDD OF FINANCING
THE SAME, INCLUDING THE ISSUANCE OF
VILLAGE CESTIFICATES OF INDEBTEDNESS FON

OF THE VILLAGE' AND MORTGAGES OF SAID GOLF
COURSE; AND RELATING GY TO SAID PRT

BE IT RESOLVED BY THE COUNCIL OF NTAINI SHORES VILLAGEt
SECTION 1.' An election is hereby called in said
Village to be held at the Village office between S o'clock A. ffi., and
sundown, on Mondays November 283, 1937, for the purpose of approving
or disapproving Ordinance No. L:)4 and all ordinances, contracts and
acts of the Village Council,' officers and attorneys, in acquiring and
arranging to acquire lands for a golf course and in arranging for the
construction and financing of said golf course, including issuance of
general obligation certificates of indebtedness for $1.0,000 and interest;
execution and delivery of a mortgage for $209000 to Ethel Me Haack; the
execution and delivery of a mortgage for 01.34sb16.00 to Bessemer Properties,
Incorporated; conveyance to Bessemer Propei.es, Incorporated, of part of
said lands not needed for said golf course; the making of an operating
contract and franchise to Miami Shores Golf and Country Club, Inc; the
employment of R. F. Lawrence, and Robert L. Weed, Architect, Inc; the
delegating of a golf course committee to supervise and control its con—
struction, maintenance, operation and expenses; and that the questions of
approval, or disapproval of the substance of said acts and transactions
and of all, ordinances' acts and transactions in connection with or per—
taining
ertairaing to said golf course project, be subM fitted at said election to be
voted upon by the qualified electors residing in said Village who ,aa°e
freeholders, and by all owners of real proper Y therein who shall register
and vote.
SECTION 2. Electors and property owners may qualify and
register for said election at any time not later than five days prior to the
date of holding said election. Proof by affidavit of the ownership of real
property in said Village shall be required at the time of registration;pro-
vided that any freeholder who shall be a qualified and registered elector
of said Village may participate in said election. The last assessed
valuation, of real, property owned by each registrant according to the Village
tax roll shall be noted and property owners other than real persons shall
be registered in a separate book or column or shall be designated on the
registration boob.
SECTION S. The ballots in said election shall state and submit
the substance of the several major items or proposals involved in said project,
to-wit,, shall state the entire project as one proposition or gaestion and shall
also submit separately the questions of approval of the isoance of said
certificates and of the execution and delivery of the mortgages to Ethel M,
Hawk and Bessemer Properties, Incorporated# authorised in said ordinance Noe,
and of the franchises authorized and contemplated in said ordinance; and the
ballots cast by other than real persons residing in the Village shall, be
separately cast and separately costed. The Village Manager shall publicise
the substance„and details of said project, and the ordinances and proposals re-
lating thereto' by letters, bulletins and other`,wioes and shall inform the
electors and property owners concerning the acme so far as practicable..
SMCTION 4. Said election shall be held,, conducted and canvassed
In all respects as provided by the Constitution and by the laws and ordinances
applicable thereto and the form of the ballots shall be as so provided,
SECTION So The Council hereby appoints

as clerk of said election, to have and exercise all the powers thereto appertain-
ing ander the lags and ordinances governing said election. l List of the
qualified electors who shall be determined to be freeholders and entitled to
participate in said election shall be made up and certified and a certified copy
thereof furnished to said inspectors and clerk at or before the opening of
the polls for said election and shall be preserved among the records of the
council.
BEON 6. The official fora of the ballots for said election
shellbe submitted to the council before being printed or used and shall be
subject to Its approval.
SECTION 7. If said entire project and the several iteme or proposals
involved therein and all questions submitted at said election shall not be
approved by the votes--of a majority of the qualified electors and freeholders
voting In said election, or if a majority of the qualified and registered
electors residing In said Village on said election day, who at such time are
freeholdere, shallnot participate in said election, or if the owners of a
majority in amount of real property in said Village according to said last
assessed values thereof who shall register and vote in said election, shall not
approve said entire project and said certificates of Indebtedness and said
mortgages, contracts and franchises, then and thereupon all of said golf course
lands, upon request therefor, shallbe conveyed and released to Bessemer
Properties, Incorporated, subject to said mortgage to Ethel M. Hauk, and all
rights in contracts by the Village to purchase parts of said lands shall be
assigned to Bessemer Properties, Incorporated, and the said mortgage or pro—
posed mortgage to said corporation shall be cancelled and shall become of no
' further force or effect; and said certificates of indebtedness shall not be
issued.
&SMON 8, originals or copies of all mortgages, deeds, maps,
plans, contracts and other documents or papers made or proposed to be made
concerning said golf course or the lands therefor <phall be kept on file and
available to any elector, freeholder or property owner, in the Village offices
continuously to and.includiug the day of said elections
