R-11-35 (2) A RESOLUTION APPROVING THE EXECUTION AND
DELIVERY OF A SPECIAL WARRANTY DEED TO
SOUTHERN BRICK & TILE CO. , A FLORIDA
CORPORATION, C0NVEYING THE INTEREST THE
VILLAGE ACQUIRED BY DEED FROM FRED BOTTS
AS SPECIAL MASTER TO SAID VILLAGE, PURSUANT
TO DECREE AND SALE IN THE CASE OF MIAMI
SHORES VILLAGE VS. F. M. AKERS, ET AL. , IN
CHANCERY NO. 38062, IN FORECLOSURE OF THE
LIENS OF SAID VILLAGE FOR TAXES ASSESSED
AND DUEIN THE YEAR 1932, UPON CONSIDERATION
OF THE PAYMENT OF THE AMOUNT OF TAXES,
INTEREST AND COSTS THE VILLAGE HAS IN CERTAIN
PROPERTY.
WHEREAS a deed has been presented to the Council for approval
for conveyance of the interest of the Village to Southern Brick &
Tile Co. , a Florida corporation, nominee of Recovery Corporation, of
the following described property located in Miami Shores Village,
Dade County, Florida:
The following lots in Miami Shores, Section 1, a
subdivision in said county, per Plat recorded in
Plat Book 10, page 70, Public Records of Dade
County:
Lot 11 of Block 6; Lot 12 of Block 7; Lots 11 and
12 of Block 11; Lot 12. of Block 12; Lot 3 of Block
15; Lot 1 of Block 19; Lot 2 of Block 19 and Lot 15
of Block 29.
The following lots in Miami Shores, Section 5, a
subdivision in said county, per Plat recorded in
Plat Book 10, page 47, Public Records of Dade
County:
Lot 13 of Block 120 and Lot 4 of Block 127.
The following lots in Miami Shores, Section 6, a
subdivision in said county, per plat tecorded in
Plat Book 10, page 39, Public Records of said
County:
Lot 8 of block 128; Lots 12, 16, 17, 18, 19 and
20 of Block 133; Lots 11 10, 11, 14 and 23 of
Block 135.
The following lots in Miami Shores, Section 8,
a subdivision in said county, per plat recorded
in Plat Book 14, page 33, Public Records of said
County:
Lots 13, 14, 15, 16, 17, 18 and 19, of Block 170,
AND WHEREAS the village holds some interest therein by deed
of Fred Botts as Special ivlaster to said Village, pursuant to decree
and sale in the case of diami Shores Village vs. F. M. Akers, et al. ,
in Chancery No. 38062, in foreclosure of the liens of said Village
for taxes assessed and due in the year 1932, and
WHEREAS said deed only specially warrants the title to said
land so described, and
WHEREAS a copy of said deed has been presented with this
resolution and attached hereto, and
WHEREAS Southern Brick & Tile Co. , a Florida corporation,
has offered in consideration of the execution of said deed of con-
veyance of said property the sum of Two hundred and fifty-four dollars
and one cent ($254.01) the amount of taxes and interest and costs
which said Village has in said property, and
WHEREAS said property is not of such a character as to con-
situte property which might be used by the Village for park purposes;
NOW THEREFORE, BE IT RESOLVED that the Mayor and Village Clerk
are hereby authorized to execute said deed to Southern Brick & Tile
Co. , aFlorida corporation, conveying whatever interest the Village
has in and to said property sodescribed, and to deliver the same to
Southern Brick & Tile Co. , a Florida corporation, upon receipt of the
sum of Two hundred and fifty-four dollars and one cent ($254.01 ) in
consideration of the execution of the same, provided that all expenses
in connection therewith shall be borne by the said grantee so named.
