A RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF A RIGHT OF WAY DEED TO DADE COUNTY, FLORIDA, OF CERTAIN INTEREST IN PROPERTY ACQUIRED BY THE VILLAGE BY DEED OF FRED BOTTS AS SPECIAL MASTER TO SAID VILLAGE, PURSUANT TO DECREE AND SALE IN THE CASE OF MIAMI SHORES VILLAGE VS. F. M. AKERS, ET AL, IN CHANCERY NO. 380623, IN FORECLOSURE OF LIENS OF SAID VILLAGE FOR TAXES ASSESSED AND DUE IN THE YEAR 1932. WHEREAS the Village has acquired some indefinite amount of interest in and to property formerly known as the West Three hundred and thirty (330) feet of Lot nAn, Subdivision of Government Lot 4, Section 6, Township 53 South, Range 42 East by deed of Fred Botts as Special master to said Village, pursuant to decree and sale in the case of Miami Shores Village vs. F. M. Akers, et al., in Chancery No. 38062, in foreclosure of the liens of said Village for takes assessed and due in the year 1932, and WHEREAS a portion thereof has been occupied for some time by what is known. as Federal Highway, and WHEREAS the County of Dade has- requested of the Village a deed to a strip one hundred (100) feet in width, being fifty (50) feet on each side of the center line of the said Federal Highway traversing the said west three hundred and thirty (330) feet of Lot nAn, Subdivision of Government Lot 41 Section 6, Township 53 South, Range 42 East, and WHEREAS the Village is willing to deed- whatever interestit has in said land as described, but is unable to definitely determine the exact quantity thereof, and WHEREAS the Village has deeded to Albert S. Barnott the west three hundred and thirty (330) feet of Lot nAn, Subdivision of Government Lot 4, Section 6, Township 53 South, Range 42 East, less the Federal Highway. NOW THEREFORE, BE IT RESOLVED that the Mayor and Village Clerk are hereby authorized to execute a right of way deed to Dade County, Florida, for the interest which it may have in and to the said west three hundred and- thirty (330) feet of Lot nAn, Subdivision of Government Lot 41 Section 61 Township 53 South, Range 42 East, and said deed to contain M K � V � no warranties whatsoever, and only to describe the property to be conveyed as the right, title and interest owned by the Village in and to said property occupied by said Federal Highway as the result of said foreclosure as aforesaid. BE IT FURTHER RESOLVED that no consideration be exacted from the said County for the execution and delivery of said deed, except all costs and expenses in connection therewith be borne by said Dade County.
