AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL
AMENDING SECTION 400,DISTRICT"R"OF THE"SCHEDULE
OF REGULATIONS"CONTAINED IN THE ZONING APPENDIX
OF THE VILLAGE'S CODE OF ORDINANCES, PROVIDING FOR
SEVERABILITY,PROVIDING FOR CONFLICTS AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS,The Village Council previously requested that the Planning Board review the
residential height provisions of the Code as they relate to properties located in the VE 11 flood zone,
and thereafter the Planning Board conducted a number of workshops and public hearings;and,
WHEREAS, During the Planning Board's public hearing,workshop and deliberations,the Board
considered the allowable heights as set forth in the Village Code of Ordinances and subsequently
recommended that no amendments be made to the residential height restrictions, regardless of their
location within the Village;and,
WHEREAS,The Village Council believes it is in the best interest of the Village to amend the
Zoning Appendix, District"R" of Section 400,Schedule of Regulations contained in the Village Code of
Ordinances;
NOW,THEREFORE, BE IT ORDAINED BY THE MIAMI SHORES VILLAGE COUNCIL,that:
Section 1. District "R", Section 400, Schedule of Regulations of the Zoning Appendix is
hereby amended to read as follows:
Sec. 400. - Schedule of regulations
Schedule of regulations.
Districts Maximum Building Height
R-35 For dwellings: 2 stories and shall not exceed
R-30 30 ft. in height, except that dwellings in the VE
R-28 11 flood zone shall not exceed 37 ft. in height.
R-26 For other buildings: 40 ft., excepting, for all
R-25 buildings, the features specified in Article V
R-23 and subject to the conditions set forth therein.

R-21 Accessory buildings: Not to exceed the height
R-20 of the dwelling located on the same plot.

Section 2. If any section, sentence, clause or phrase of this Ordinance,is held to be invalid
or unconstitutional by any court of competent jurisdiction, then said holding shall in no way
effect the validity of the remaining portions of this Ordinance, which shall be deemed to be
severable therefrom.
Section 3. All ordinances or parts of ordinances in conflict herewith or inconsistent
herewith, are hereby repealed, but only insofar as such ordinances may be inconsistent or in
conflict with this Ordinance.
Section 4. This ordinance shall take effect immediately upon approval and adoption on
second reading.
