AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL,AMENDING
SECTION 523.1 AND CREATING 523.1 (k)OF THE ZONING APPENDIX A,
CONTAINED IN THE CODE OF ORDINANCES OF MIAMI SHORES VILLAGE,
FLORIDA,CONDITIONALLY PROVIDING FOR HYBRID ROOFS,SETTING
FORTH THOSE CONDITIONS,PROVIDING FOR CONFLICTS, PROVIDING
FOR SEVERABILITY,PROVIDING A SUNSET PROVISION,AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, During the February 15, 2011 Council Meeting,the Council requested that the
Planning&Zoning Board consider an amendment to the Code of Ordinances Zoning Appendix to allow
for the installation of hybrid roofing systems in Miami Shores Village;and,
WHEREAS,Together with the Planning Director,the Planning&Zoning Board reviewed
information pertinent to hybrid roofs and held a public hearing at which testimony was offered;and,
WHEREAS,The Planning&Zoning Board,during their meeting of May 27,2011,voted to
recommend approval of a code amendment conditionally allowing for hybrid roofs in Miami Shores
Village;
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA:
Section 1. That Section 523.1 (k)of the Zoning Appendix A,contained in the Miami Shores
Village Code of Ordinances is hereby created and shall read as follows:
Sec.523.1 (k) Hybrid Roofs.
In addition to the roofing materials permitted under Sec. 523.1.Construction,the following
hybrid roofing systems and materials may be permitted:
1) A metal pan tile with clay cap tile roofing system may be utilized for residences subject to
Planning Board review and approval and in accordance with the following criteria:
(a) All roof sections must begin and end with clay cap tiles at the hip, rake and ridge lines,
and not begin or end with pan tiles. The rake line must end with a cap tile and rake tile.
(b) Clay cap tiles are to be set perpendicular to the roof eave in a straight line from the eave
to the roof ridge with a variation in spacing between the rows of not more than four(4)
inches within a variation of one(1) inch plus or minus.
(c) The clay cap tile shall be impregnated with the same color intensity throughout.
(d) The metal pan tiles and clay cap tiles shall be of natural clay colors and shall match each
other in color to the greatest extent possible.
(e) The details, color,and manner of installation shall be consistent with the architectural
design,style, and composition of the residential structure,the neighborhood and
community.
(f) No material of any kind shall be placed between the clay cap tiles except for the metal
pan tiles.
(g) All work on the construction,alteration or repair of roofs shall be performed in a good
and workmanlike manner according to accepted standards and practices in the trade.
Section 2. All ordinances or parts of ordinances in conflict herewith or inconsistent
herewith, are hereby repealed, but only insofar as such ordinances may be inconsistent or in conflict
with this Ordinance.
Section 3. If any section,sentence,clause or phrase of this Ordinance is held to be invalid
or unconstitutional by any court of competent jurisdiction, then said holding shall in no way effect the
validity of the remaining portions of this Ordinance,which shall be deemed to be severable therefrom.
Section 4. This Ordinance shall become effective immediately upon adoption on second
reading, and the provisions of Section 523.1(k)shall expire and automatically sunset as of February 15,
2012,and shall thereafter have no force or effect unless reenacted prior thereto.
