AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI
SHORES VILLAGE AMENDING ZONING ORDINANCE NO.
270 ARTICLE IV, DIVISION 5, SECTION 521, REQUIRED
OFF-STREET PARKING FOR STUDIO ARTS IN THE C
DISTRICT; AND, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Shores Land Development and Zoning Code sets forth the
minimum number of required off-street parking spaces for all categories of businesses
located in Miami Shores; and,
WHEREAS, the Village finds that it would be appropriate to amend the minimum
required parking spaces for exercise studios located in C zoning districts of the Village;
and,
WHEREAS, the Village Council of Miami Shores Village, Florida, has determined
that it would be in the best interests of the citizens and residents of Miami Shores Village,
through the amendment of Miami Shores Village Zoning Ordinance No. 270, Article IV,
Section 521, Minimum Off-Street Parking Schedule Requirements By Usage,to modify the
off-street parking requirement for exercise studios in the C zoning districts of the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF MIAMI
SHORES VILLAGE, FLORIDA:
SECTION 1: That the foregoing Whereas clauses are hereby ratified and
confirmed as being true and correct, and are hereby made a specific part of this Ordinance
upon adoption hereof.
SECTION 2: That the Minimum Off-Street Parking Schedule Requirements
By Usage, being a part of Article IV, Section 521, of the Miami Shores Village Zoning
Ordinance No. 270, which is incorporated into the Miami Shores Land Development and
Zoning Code, is hereby amended, with respect to those provisions entitled "STUDIO
ARTS", by deletion of the stricken-through language and addition of the underlined
language, to read as follows:
Spaces Required: Loading Spaces
Required:
"STUDIO ARTS:
Health clubs, spas, fitness 1 space/100 sq. ft. of 1 space/25,000
clubs, karate, dance, or instructional or exercise area sq. ft. of building
instructional classes plus 1 space per 250 sq. ft. of floor area
additional area
Exercise studios in C 1 space/350 sq. ft. 1 space/25,000
Districts only sq. ft. of building
floor area"
SECTION 3: That all ordinances or parts of ordinances in conflict herewith or
inconsistent herewith are hereby repealed, but only insofar as such ordinances may be
inconsistent or in conflict with this Ordinance.
SECTION 4. If any section, sentence, cause or phrase of this Ordinance is
held to be invalid or unconstitutional by any court of competent jurisdiction, then said
holding shall in no way effect the validity of the remaining portions of this Ordinance,which
shall be deemed to be severable therefrom.
SECTION 5: This Ordinance shall become effective immediately upon its
passage and adoption.
