AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA,
AMENDING SECTIONS 9-42 (1), (1)(a), (2), AND (3), OF THE
VILLAGE CODE OF ORDINANCES, RELATING TO THE FEES
CHARGED FOR GARBAGE &TRASH COLLECTION,TO PROVIDE
FOR AN INCREASE IN SAID FEES, PROVIDING FOR CONFLICTS,
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, There have been increases in labor costs,fuel costs,
insurance costs, including worker's compensation and liability insurance, and
garbage tipping fees over the last several years; and
WHEREAS, The Village has been able to absorb the increases since the
last rate increase; and
WHEREAS,The last garbage and trash fee increase was effective October
1, 2004; and
WHEREAS,To keep abreast of the rising costs to provide garbage and
trash pick-up service, it is in the best interests of the Village to now raise the
residential garbage rate fee;
NOW,THEREFORE, BE IT ORDAINED by the Miami Shores Village Council
that:
Section 1. The introductory paragraph of Section 9-42, as well as Sub-
Sections 9-41 (1), (1)(a), (2) and (3) of the Miami Shores Village Code of
Ordinances are hereby amended to read as follows:
Effective October 1, 2007, each person,firm, corporation, partnership or
other legal entity who is the owner of each lot, tract, or parcel of land in any area
in the Village where waste collection service is provided by the Village, shall pay
for residential and commercial refuse collection the following fees:

a. Auxiliary living unit(one 30-gallon can) . . $353.00
(2) Duplexes, per unit. . . . . . . . . . . . . . . . . . . . . . . . . $705.53
(3) Apartment rentals, condominiums and co-ops
(each 30-gallon can per unit) . . . . . . . . . . . . . . $353.00
Section 2. The remainder of Section 9-42 (commencing with Section 9-
42 (3)(a)through and including Section 9-42 (5)(g) shall remain as previously
enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith or
inconsistent herewith are hereby repealed, but only insofar as such ordinances
may be inconsistent or in conflict with this Ordinance.
Section 4. Due to time constraints and the necessity of timely printing
the October 1, 2007 utility service invoices,the passage of this Ordinance is
required on an emergency basis.
Section 5. This Ordinance shall become effective immediately, and the
fee increases setforth herein shall commence with the October 1, 2007 billing.
PASSED AND ADOPTED ON AN EMERGENCY BASIS ON THIS 4th
of September . 2007.
