AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL
AMENDING SECTION 6.7 OF THE MIAMI SHORES VILLAGE CODE
OF ORDINANCES RELATING TO BUILDING PERMIT FEES;
PROVIDING FOR FEES FOR RIGHT-OF-WAY CONSTRUCTION,
PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the Village Council, during the Fiscal Year 2004-2005 Budget Workshop,
discussed an increase to certain building permit fees; and
WHEREAS, it is in the best interests of the Village to adopt an amending Ordinance
which would effect the proposed increases for certain and specific permits, and provide a
permit fee category for right-of-way construction; and
WHEREAS,the proposed rate structure will bring the effected building permit fees
more closely in line with fees charged by other local municipalities;
NOW, THEREFORE, BE IT ORDAINED BY THE MIAMI SHORES VILLAGE
COUNCIL:
Section 1. Those portions of Section 6.7 of the Code of Ordinances of Miami
Shores Village set forth below, are hereby amended so as to include the underlined additions or
changes where indicated:
Sec. 6-7. Permits—Fees
Building Permit Fees: The Building Director or designee is authorized to charge
the fees as were in existence prior to the effective date of this amended fee schedule for those
subcontract permits, i.e. electrical, plumbing, mechanical, etc., where the master building
permit was issued prior to the effective date of this amended fee schedule, and where there is
submitted written evidence such as a signed and dated copy of the subcontract entered into
prior to the effective date of this amended fee schedule.
GENERAL FEE SCHEDULE
Where fees are based on Estimated Cost Documentation requirement,the Building
Department may require the permit applicant to submit appropriate documentation as proof of
estimated cost of construction used to compute fees. Where fees based upon "value", Building
Department may determine same based upon generally accepted published authorities.

Section 2. The remainder of Section 6.7 of the Miami Shores Village Code of
Ordinances shall remain as currently enacted.
Section 3. All ordinances or parts of ordinances in conflict herewith or inconsistent
herewith are hereby repealed, but only insofar as such ordinances may be inconsistent
or in conflict with this Ordinance.
Section 4. If any section, sentence, clause or phrase of this Ordinance is held to
be invalid or unconstitutional by any court of competent jurisdiction, then said holding
shall in no way effect the validity of the remaining portions of this Ordinance,which shall
be deemed to be severable therefrom.
Section 5. This Ordinance shall become effective immediately upon its final adoption.
