O-636-02 ORDINANCE NO. 636-02 AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL, MIAMI SHORES VILLAGE, FLORIDA, AMENDING SECTION 16-19 OF THE MIAMI SHORES VILLAGE CODE OF ORDINANCES, RELATING TO USE OF THE RECREATION DEPARTMENT FACILITIES BY RESIDENTS, SPECIFYING RESIDENT TO GUEST RATIOS, PROVIDING FOR CONFLICTS, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The Village Administration has determined that a need exists to clarify the resident to non-resident/guest ratio requirements for use of the Village's various recreation facilities; and WHEREAS, In order to enforce the existing usage policies, the clarification should be codified and included in the Village's Code of Ordinances; and WHEREAS, It is in the best interests of the Village to provide for regular upkeep and maintenance in order to safeguard the Village's facilities; and WHEREAS, It is in the best interests of the Village to specifically list the allowable resident to non-resident/guest ratios; NOW,THEREFORE, BE IT ORDAINED by the Village Council of Miami Shores Village that: Section 1. That Section 16-19 of the Miami Shores Village Code of Ordinances is hereby amended to read as follows: Only persons who are residents of the village shall be entitled, upon compliance with such regulations, to use the recreational facilities of the village subject to the following conditions which shall prevail: 1) Athletic Fields located adjacent to the Ed Abdella Field House at 9825 Park Drive, Miami Shores. a) When not otherwise in use for scheduled Village activities, such fields shall be available for use by Village residents and not more than one invited non-resident guest accompanying each resident. b) Said athletic fields shall be closed to all activities on Sundays prior to 12:01 p.m. C) Sports cleats are prohibited on said fields except during Village organized or sponsored activities. 2) Basketball Courts located adjacent to the Lawton McCall Community Center at 9617 Park Drive, Miami Shores. a) When not otherwise in use for scheduled Village activities, said basketball courts shall be available for use by Village residents and not more than one invited non-resident guest accompanying each resident. b) Said basketball courts are open for use during the Community Center's normal business hours. 3) Aquatic Center located at 10200 Biscayne Boulevard, Miami Shores. a) The aquatic facility shall be available for use by Village residents, pursuant to payment of the applicable fees in force at the time of use, and not more than three invited non-resident guests accompanying each resident. 4) The use and possession of alcoholic beverages at all facilities is prohibited at all times unless authorized by written permission of the village manager. 5) The limitation of use of said facilities by non-residents does not apply to organized activities that are sponsored or authorized by the village. Section 2. All ordinances or parts of ordinances in conflict herewith or inconsistent herewith are hereby repealed, but only insofar as such ordinances may be inconsistent or in conflict with this Ordinance. Section 3. This Ordinance shall become effective immediately upon its adoption on second reading. Passed on first reading this 17th day of September 2002.
