O-633-02 ORDINANCE NO. 633-02
AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA,
AMENDING SECTION 20-104(c), OF THE VILLAGE CODE OF
ORDINANCES, RELATING TO THE STORMWATER UTILITY FEES,TO
PROVIDE FOR AN INCREASE IN SAID FEES, PROVIDING FOR
CONFLICTS, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, There has been an increase in the costs of insurance in all
categories; and
WHEREAS, A fee increase is required in order to safeguard the Village's
drainage and stormwater infrastructure and allow for future expenditures in
drainage and stormwater projects; and
WHEREAS, It is in the best interests of the Village to now raise the
quarterly rate charged in connection with the stormwater utility services;
NOW,THEREFORE, BE IT ORDAINED by the Miami Shores Village Council
that:
Section 1. Section 20-104(c) of the Miami Shores Village Code of
Ordinances is hereby amended to read as follows:
(c) The fee assessed against each account shall be determined by
multiplying, on a quarterly basis, $8.00 which represents the
stormwater utility service charge, by the number of ERU's for each
account. The amount of such fee shall be shown as a separate item
on the Village garbage bills (or as shown on a stormwater utility bill
if no garbage bill is issued) and shall be paid by the owner, tenant,
or occupant in possession of the premises.
Section 2. All ordinances or parts of ordinances in conflict herewith or
inconsistent herewith are hereby repealed, but only insofar as such ordinances
may be inconsistent or in conflict with this Ordinance.
Section 3. Due to time constraints and the necessity of printing the
October 1, 2002 utility service invoices,the passage of this Ordinance is
required on an emergency basis.
Section 4. This Ordinance shall become effective immediately and the
fee increase setforth herein shall commence with the October 1, 2002 billing.
PASSED AND ADOPTED ON AN EMERGENCY BASIS ON THIS 16th
of July , 2002.
