O-630-01 ORDINANCE NO. 630-01
AN ORDINANCE OF MIAMI SHORES VILLAGE, FLORIDA,
AMENDING SECTION 20-102 AND SECTION 20-104 (b) OF
THE VILLAGE CODE OF ORDINANCES,RELATING TO THE
ESTABLISHMENT OF A STORMWATER UTILITY FUND,
CORRECTING THE DEFINITION OF AN ERU(EQUIVALENT
RESIDENTIAL USAGE UNIT), PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, On September 5, 2000,the Village Council adopted on second and final
reading, Ordinance No. 620-00, which established a Stormwater Utility Fund; and
WHEREAS, Within the tent a definition of an ERU(Equivalent Residential Usage Unit)
was provided at sections 20-102 and 20-104(b) of the Village Code; and
WHEREAS, The number of square feet provided therein as the estimated average of
impervious area used to calculate the ERU was erroneously stated as 1,548 square feet; and
WHEREAS, The correct number of square feet to be used as the estimated average of
impervious area is 2,466;
WHEREAS, It is in the best interest of the Village to correct this typographical error as
soon as possible;
NOW, THEREFORE, BE IT ORDAINED by the Miami Shores Village Council that:
Section 1. Section 20-102 of the Miami Shores Village Code of Ordinances is
hereby amended to read as follows:
ERU(Equivalent Residential Usage Unit) The statistically estimated average of
impervious area of residential developed properties per dwelling unit within Miami Shores
Village. This estimated average(which equals 2,466 square feet) is calculated by dividing the
total estimated impervious area of residential properties by the estimated total number of
dwelling units.
Section 2. Section 20-104 (b) of the Miami Shores Village Code of Ordinances is
hereby amended to read as follows:
(b) For the purpose of this article, each dwelling unit is assigned one ERU. For
properties which do not contain a dwelling unit(i.e. non-residential developed properties),the
ERU is calculated by dividing the impervious area on the properly by 2,466 square feet, (e.g. a
non-residential developed property containing 4,932 square feet of impervious area is equivalent
to 2 ERUs).

Section 3. This Ordinance is effective,immediately upon it adoption.
