O-623-00 ORDINANCE NO. 623-00 AN ORDINANCE OF MIAMI SHORES VILLAGE,FLORIDA, AMENDING CHAPTER 1 OF THE MIAMI SHORES VILLAGE CODE OF ORDINANCES,BY ADDING A SECTION TO BE NUMBERED 1.2.1, SETTING FORTH THE REQUIREMENT THAT CERTAIN BOARD/COMMITTEE MEMBERS APPOINTED BY THE VILLAGE COUNCIL BE MIAMI SHORES VILLAGE RESIDENTS, PROVIDING FOR CONFLICT, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Village Council has historically appointed Miami Shores Village residents to the various volunteer Boards and Committees of the Village; and WHEREAS,the Code does not contain specific language outlining the intended residency requirement; and, WHEREAS, it is in the best interest of the Village to clarify the Code in this respect; NOW, THEREFORE, BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA Section 1. The Code of Ordinances of Miami Shores Village,Florida, is hereby amended by adding a Section 1.2.1, which said Section shall read as follows: 1) Residency in the Village is an eligibility requirement for appointment by the Council to the following Village Boards and/or Committees: Code Enforcement Board, Planning& Zoning Board, Library Board of Trustees, Fine Arts Commission,Recreation Advisory Board,Historic Preservation Board, Personnel Appeals Board, Country Club Advisory Board, and any future boards or committees established by the Village Council. 2) Any member of any of the above listed Boards/Committees who ceases to be a resident of the Village shall thereupon promptly submit a resignation in writing to the Village Clerk and such vacancy shall be filled in accordance with existing Ordinances. 3) The residency eligibility requirement shall not apply with respect to the Police Retirement Pension Board and the General Employee Pension Board employee representative appointments. Section 2. All ordinances or parts of ordinances in conflict herewith or inconsistent herewith are hereby repealed,but only insofar as such ordinances may be inconsistent or in conflict with this Ordinance. Section 3. This Ordinance shall become effective immediately upon its adoption. PASSED ON FIRST READING,this 5th day of September . 2000.
