O-604-98 ORDINANCE NO. 604-98 AN ORDINANCE ADOPTING SUPPLEMENT NUMBER 11 TO THE CODE OF ORDINANCES,MIANII SHORES VILLAGE,FLORIDA,WHICH SUPPLEMENT INCLUDES AMENDMENTS OF SECTIONS TO CONFORM TO STATE LAW CHANGES AND TO REORGANIZE THE ZONING APPENDIX TO TRANSFER CERTAIN PROVISIONS FROM THE DEFINITIONS ARTICLE TO THE SUPPLEMENTARY REGULATIONS ARTICLE AND TO DELETE FALLOUT OR BOMB SHELTERS FROM THE PERMITTED USES AS OBSOLETE AND INCLUDING EXPLANATORY SECTIONS REGARDING NOTES OR REFERENCES INSERTED IN THE CODE BY THE PUBLISHER,AND DELETING AND AMENDING OBSOLETE PROVISIONS;PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY NUANII SHORES VILLAGE: Section 1. Supplement number 11,including the following amendments to the Code of Ordinances,Miami Shores Village,Florida,which supplement is attached hereto as Exhibit A,is hereby adopted. Chapter 1 is amended to include a definition of Charter and Code to mean and refer to that of Miami Shores Village,Florida and to include an explanation of references and editor's notes inserted by the publishers. Chapter 2,section 2-76 et seq. regarding Code Enforcement is amended to include the state law amendments to F.S. ch. 162. Chapter 4,section 4-3 regarding sale of alcoholic beverages at gasoline filling stations is deleted as superseded by the state alcoholic beverage regulations. Section 4-4(3)is amended by including the hours for sale for alcoholic beverages on university premises. Chapter 7,section 7-1 is amended as the county determines the polling places. Section 7-18 through 7-22 have been deleted as the Village has adopted the Security Procedures for Voting System Manual which will be adopted by reference in section 7-18. Supp.No.11 xi Chapter 14,sections 14-28 and 14-29 regarding transfer of the occupational license have been amended to conform to the amendments to the fees in F.S.204.053. Section 14-31(b)(2)through(8), (d)and(e)have been deleted as the occupational license is a tax and is revoked only if the application for such license contains false information and the licensee is given an opportunity to appeal such revocation in amended subsection(c). Section 14-33(a)is amended by deleting the dog racing tax as obsolete. Chapter 18,section 18-1 which adopts the state law is deleted as the Village has a policy on sick leave and the reference to the state law is obsolete. Section 18-16 on the personnel appeals board has been amended to delete the initial appointments and the requirement to attend training sessions is obsolete. Chapter 19,section 19-1 adopting the comprehensive plan has been amended to reference the plan as amended from time to time as the comprehensive plan is adopted as a separate document and is only referenced in the Code of Ordinances. Chapter 20,section 20-71 is amended to delete the initial appointments to the library board. Chapter 21,section 21-31 et. seq.regarding the public service tax has been amended to conform to the amendments to F.S. 166.231 et seq. Appendix A,article II,sections 217.5,220,221,224,225,228,and 240 have been amended to transfer the substantive requirements in such definitions to the referenced sections in Article V, Supplementary Regulations. The Schedule of Regulations has been amended to delete fallout or bomb shelters as a permitted use as obsolete. Section 536 regarding landscaping design standards has been amended to change vehicular use to vehicular driveways as a clarification. Section 609 regarding permits is amended to apply to all schools by deleting the word"private"before schools. Section 702 regarding variances has been amended to delete as obsolete the reference to the variance being subject to the approval of the Village Council. Section 901(g)is amended to delete as obsolete the requirement for filing a duplicate of every certificate of occupancy with the Village Clerk. Section 1100 is amended to delete the reference to hard labor on the streets of the Village in the penalty as it is of questionable validity and obsolete. Section 1101 is amended to change the term building official to code enforcement officer as the person who issues notices of violation. Supp.No.11 xii Section 2.
