AN ORDINANCE AMENDING SCHEDULE OF REGULATIONS, BEING A PART
OF ARTICLE V. OF THE MIAMI SHORES VILLAGE ZONING ORDINANCE
NO. 270; EXPANDING STATED PERMITTED USES IN B-1 AND B-2
DISTRICTS; ADDING LIST OF USES NOT DEEMED TO BE INCLUDED IN
STATED PERMITTED USES; AUTHORIZING ESTABLISHMENTS FOR MINOR
MOTOR VEHICLE REPAIRS AND, BY DEFINITION, LIMITING SAME;
ESTABLISHING EFFECTIVE DATE.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
SECTION 1. Permitted Uses in District B-1 Zones as set forth
in the Schedule of Regulations, being a part of Miami Shores Village
Zoning Ordinance No. 270, reads as follows :
B-1 Permitted Uses
1. All uses, other than dwellings, that are permitted in R
districts.
2 . Retail stores in completely enclosed buildings, but not
including handling of live poultry or other animals .
3. Bakeries producing goods only for retail sale on the pre-
mises and not employing more than 5 persons.
4 . Personal service establishments (barbershops, beauty par-
lors and similar establishments) .
5. Banks, offices and studios.
6 . Shoe repairing, hat cleaning, clothes pressing, interior
decorating, costuming and tailoring shops .
7 . Restaurant in which service is provided primarily at tables
entirely within a building may also provide service to cus-
tomers outside of the building (not in motor vehicles) but
entirely within the boundaries of the plot on which such
restaurant is located, and only in places designated there-
for, on the site plan approved for such use, as provided in
Article VI . Restaurants with a seating capacity of 32
table seats, or more, and a minimum of 1,000 square feet of
entirely enclosed dining area may, as an incidental part of
said business, serve beer or wine for consumption on the
premises only, subject to the following conditions :
(a) The sale or consumption of beer and wine at bars or
counters shall not be permitted.
(b) The principal and primary business must consist of
dispensing food.
(c) Food shall be prepared, offered and served during all
business hours.
(d) No such business shall have signs advertising the sale
of beer and wine upon the exterior thereof or within
said establishment, if the same is visible from the
exterior thereof.
(e) No beer or wine shall be served during the hours be-
tween 12 midnight one day and 11:00 a.m. the suc-
ceeding day.
SECTION 2 . B-1 Permitted Uses shall stand amended to read as
follows:

SECTION 3 . Permitted Uses in District B-2 Zones as set forth
in the Schedule of Regulations being a part of Miami Shores Village
Zoning Ordinance No. 270 reads as follows:
B-2 Permitted Uses
1. All uses permitted in B-1 districts, subject to all limita-
tions therein, except that restaurants in which service is
provided primarily at tables or counters entirely within a
building may also provide service, except for beer and
wine, to occupants of motor vehicles standing entirely
within the boundaries of the plot on which such restaurant
is located and in places designated therefor on the site
plan approved for such use, as provided in Article VI .
2 . Hotels, subject to the regulations applying to hotels in
A-2 districts .
3. Establishments for general motor vehicle repair (which may
include body work, welding and painting) but only in con-
nection with sales and show rooms for new automobiles and
on the same plot therewith.

4 . (a) Establishments supplying hourly dry cleaning and simi-
lar kinds of cleaning of wearing apparel .
(b) All cleaning solutions and detergents used in such
establishments shall be odorless and methods of using
the same as well as the containers in which they are
kept shall be approved by the board of fire under-
writers and no noxious fumes or vapors shall be per-
mitted.
(c) All such businesses shall be so operated so as not to
constitute any public or private nuisance.
(d) Every business so conducted shall not employ more than
five employees which shall include within its scope
the owners and operators of said business, and shall
not occupy floor space of more than 1,500 sq. ft. in
any one approved location.
(e) Duly authorized officials of this village shall have
the right at all reasonable times to inspect the pre-
mises of businesses permitted hereunder.
SECTION 4 . B-2 Permitted Uses shall stand amended to read as
follows:

SECTION 5. Miami Shores Village Zoning Ordinance No. 270
shall be further amended by adding thereto Section No. 217 .5, which
shall read as follows:

Section 217 .5 Minor Motor Vehicle Repairs .
Minor motor vehicle repairs, excluding any body work, welding,
painting, engine or radiator rebuilding, transmission repair, repair
work on buses or trucks of 1 1/2 ton capacity or more. Overnight
outdoor storage of vehicles, including rental vehicles, shall be
prohibited.
SECTION 6 . This ordinance shall become effective on the date
of adoption.
PASSED AND ADOPTED on first reading on the 2nd day of
February 19013
PASSED AND ADOPTED on final reading on the 16th day of
February 1993.
