O-547-91 ORDINANCE No. 547-91 AN ORDINANCE AMENDING SECTION 3-17, SECTION 3-19 AND SECTION 3-22 OF ARTICLE II, CHAPTER 3 OF THE CODE OF ORDINANCES OF MIAMI SHORES VILLAGE, FLORIDA; REDEFI- NING ALARM BUSINESS; ADDING DEFINITION OF ALARM PERMIT; PROHIBITING ALARM SYSTEMS WITHOUT PERMIT; ESTABLISHING ALARM SYSTEM PERMIT FEE; PROVIDING MEANS FOR REVOCATION OF ALARM SYSTEM PERMIT; ESTABLISHING EFFECTIVE DATE. BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA: SECTION 1. The definition of ALARM BUSINESS in Section 3-17 of the Code of Ordinances of Miami Shores Village, Florida, reads as follows : ALARM BUSINESS means the business of any individual, part- nership, corporation or other entity engaged in selling, leasing, maintaining, servicing, repairing, altering, replacing, moving or installing any alarm system or in causing any alarm system to be sold, leased, maintained, serviced, repaired, altered replaced, moved or installed in or on any building, structure or facility. SECTION 2 . The definition of ALARM BUSINESS shall be expanded, and the definition of ALARM PERMIT shall be added to Section 3-17 of said Code of Ordinances so that same shall read as follows: ALARM BUSINESS means the business of any individual, part- nership, corporation or other entity engaged in selling, leasing, maintaining, servicing, repairing, altering, replacing, moving or installing any alarm system or in causing any alarm system to be sold, leased, maintained, serviced, repaired, altered replaced, moved or installed in or on any building, structure or facility. An alarm business shall be a burglar alarm specialty electrical contractor which shall have, as a qualifying agent, a master burglar alarm technician with a valid Dade County certificate of competency. An alarm business shall have an occupational license issued by the Village of Miami Shores . ALARM PERMIT means a permit issued by the village allowing the operation of an alarm system within the village. SECTION 3. Article II of Chapter 3 of the Code of Ordinances of Miami Shores Village, Florida, shall stand amended to include the following additional Sections thereof: Sec. 3-171 . Alarm user permits required; fee; renewal . (a) It shall be unlawful for any person to operate an alarm system without a valid alarm user permit. Violation of this section shall be a misdemeanor of the second degree, punishable as provided for in Chapter 775, Florida Statutes. (b) ( 1) Within thirty (30) days of the effective date of this ordinance, alarm user permits may be acquired from the village upon application and payment of a twenty dollar ($20.00) registration fee. 1 (2) After the thirty-day period, applications must be made to the village police department which will is- sue permits to alarm users after completion of a final inspection by the building and zoning inspector and payment of the twenty dollar ($20.00) registration fee. (c) All alarm user permits will expire on the thirtieth day of September of each year and must be renewed not later than the first day of October of each year. Renewal permits will be issued after completion of an applica- tion form and the payment of a twenty dollar ($20.00) renewal fee. (d) If a business has one ( 1) or more alarm systems pro- tecting two (2) or more separate structures having dif- ferent addresses, a separate permit will be required for each structure. (e) Subsections (b) through (d) of this section shall not apply in those situations where alarm user permits have been revoked under section 3-22(b) hereof. Sec. 3-172 . Application for alarm permit; emergency notifi- cation and reporting service information. (a) APPLICATIONS. Applications for alarm permits shall be made on forms provided by the police department. Each appli- cation shall be accompanied by a fee of twenty dollars ($20.00) . The application shall state the name, address and telephone num- ber of the applicant's property to be serviced by the alarm, and the name, address and telephone number of the applicant's resi- dence, if different. If the applicant's alarm is serviced by an alarm company, then the applicant shall also include the name, address and telephone number of that company. Each permit shall be valid until the thirtieth day of September of each year. (b) EMERGENCY NOTIFICATION. Each application shall list an emergency telephone number of the user or his representative to permit prompt notification of alarm calls and facilities as- sisting the police in the inspection of the property. Changes in emergency telephone numbers shall be kept current, and failure to provide updated information may constitute grounds for revocation of the permit. (c) REPORTING SERVICE INFORMATION. Each holder of an alarm user permit shall immediately notify the police department in writing of any and all changes in the information on file with the village regarding such permit. Failure to do so shall constitute grounds for revocation of the permit. Sec. 3-173. Issuance of permit decals . A decal with the alarm user's permit number will be issued with the alarm user permit. This decal must be prominently posted on or near the front entrance to the premises so that the information provided on the decal is visible from the outside of the structure. SECTION 4 . Section 3-19 of the Code of Ordinances of Miami Shores Village, Florida, reads as follows: Sec. 3-19 . Automatic reset. All alarm systems will have an automatic reset which silen- ces the annunciator within fifteen ( 15) minutes after activation and which will not sound again as a result of the same event that resulted in the original activation. 2 SECTION 5. Section 3-19 of the Code of Ordinances of Miami Shores Village, Florida, shall stand amended to read as follows : Sec. 3-19 . Automatic reset; backup power supply. All alarm systems will have an automatic reset which silen- ces the annunciator within fifteen ( 15) minutes after activation and which will not sound again as a result of the same event that resulted in the original activation. All alarm systems shall have a backup power supply that will become effective in the event of power failure or outage in the source of electricity from the utility company. SECTION 6 . Paragraph (a) and Sub-Paragraphs ( 1) and (2) of Paragraph (b) , including the preamble to said Paragraph (b) , contained in Section 3-22 of the Code of Ordinances of Miami Shores Village, Florida, read as follows: (a) It is hereby found and determined that more than seven (7) false alarms within a calendar year is excessive and hereby constitutes a nuisance. (b) The activation of eight (8) or more false alarms within a calendar year will be handled according to the following schedule: ( 1) The eighth through the ninth false alarm will be billed a service charge of fifty dollars ($50 .00) per occur- rence which shall be considered a bill owed by the alarm user to the village. Each fifty dollar ($50 . 00) service charge incurred for the eighth through the ninth false alarm at the alarm premises shall be paid within thirty (30) days from date of receipt thereof. Failure to make payment within thirty (30) days from date of receipt shall result in a discontinuance of po- lice responses to alarms that may occur at the alarm premises. (2) The tenth false alarm shall cause the following action to occur: a. The alarm user shall be given ten ( 10) days ' ad- vance written notification that a police response will not occur when an alarm is received by the police department. b. The notice shall specify the specific date of re- vocation, and that the police department will dis- continue responding to alarms that occur at the premises. C. Reinstatement of police service will be made upon receipt of a letter from an alarm company licensed by the village that the alarm system is operating properly and a one hundred dollar ($100.00) rein- statement fee. 3 SECTION 7 . Paragraph (a) and Sub-Paragraphs ( 1) and (2) of Paragraph (b) , including the preamble to Paragraph (b) , of Section 3-22 of the Code of Ordinances of Miami Shores, Village, Florida, shall stand amended to read as follows: (a) It is hereby found and determined that more than four (4) false alarms within a calendar year is excessive and hereby constitutes a nuisance. (b) The activation of four (4) or more false alarms within a calendar year will be handled according to the following schedule: ( 1) Commencing with the fourth false alarm, the alarm user will be billed as follows: 4th alarm $ 50- 00 5th alarm $ 60.00 6th alarm $ 70. 00 7th alarm $ 80. 00 8th alarm $100.00 9th alarm $150.00 10th alarm $200.00 Each service charge incurred for the fourth through ninth false alarms at the alarm premises shall be paid within thirty (30) days from date of receipt thereof. Failure to make payment within thirty (30) days from date of receipt shall result in a discontinuance of police responses to alarms that may occur at the alarm premises. (2) The tenth false alarm shall cause the following action to occur: a. The alarm user shall be given ten ( 10) days ' ad- vance written notification that a police response will not occur when an alarm is received by the police department, and that the alarm user's permit will be revoked, which written notice shall set forth the reasons for such revocation. b. The notice shall specify the specific date of re- vocation, and that the police department will discontinue responding to alarms that occur at the premises described in the revoked permit after the date of revocation. C. Reinstatement of police service and alarm permit will be made upon receipt of a letter from an alarm company licensed by the village that the alarm system is operating properly and a one hun- dred dollar ($100.00) reinstatement fee.
