O-527-89 ORDINANCE NUMBER 527-89 AN ORDINANCE AMENDING SECTION 3-22 OF THE CODE OF ORDINANCES, MIAMI SHORES VILLAGE, FLORIDA; INCREASING THE NUMBER OF FALSE ALARMS CONSIDERED TO BE EXCESSIVE WITHIN A CALENDAR YEAR; IN- CREASING THE SERVICE CHARGE FOR THE FIRST AND SECOND EX- CESSIVEFALSE ALARM FROM $25 . 00 TO $50 . 00 EACH AND ALL EXCESSIVE FALSE ALARMS THEREAFTER FROM $500. 00 TO $750. 00 EACH, AND INCREASING REIN- STATEMENT FEE FROM $75. 00 TO $100. 00; PROVIDING EFFECTIVE DATE. BE IT ORDAINED by Miami Shores Village; SECTION 1. Section 3-22 of the Code of Ordinances , of Miami Shores Village, Florida, presently reads as follows : Section 3-22. a. It is hereby found and determined that more than five false alarms within a calendar year is excessive and hereby constitutes a nuisance. b. The activation of five or more false alarms within a calendar year will be handled according to the following schedule: (1) The sixth through ninth false alarm will be billed a $25 . 00 service charge per occurrence which shall be con- sidered a bill owed by the alarm user to the Village. Each $25 . 00 service charge incurred for the sixth through ninth false alarm at the alarm premises shall be paid within 30 days from date of receipt thereof. Failure to make pay- ment within 30 days from date of receipt shall result in a discontinuance of police responses to alarms that may occur at the alarm premises . (2) The tenth false alarm shall cause the following action to occur: (a) The alarm user shall be given 10 days advance written notification that a police response will not occur when an alarm is received by the police department. (b) The notice shall specify the specific date of revocation, and that the police department will dis- continue responding to alarms that occur at the premise. (c) Reinstatement of police service will be made upon receipt of a letter from an alarm company licensed by Miami Shores Village that the alarm system is operating properly and a $75. 00 reinstatement fee. (3) On the eleventh and each subsequent false alarm the alarm user will be subject to pay a fee of $500 . 00 in addition to the conditions set forth in subsections a and b (2) hereof. SECTION 2. Section 3-22 of the Code of Ordinances , of Miami Shores Village, Florida, shall stand amended to read as follows : Section 3-22. a. It is hereby found and determined that more than seven false alarms within a calendar year is excessive and hereby constitutes a nuisance. b. The activation of eight or more false alarms within a calendar year will be handled according to the following schedule: (1) The eighth through ninth false alarm will be billed a $50 . 00 service charge per occurrence whichshallbe con- sidered a bill owed by the alarm user to the Village. Each $50 . 00 service charge incurred for the eighth through ninth false alarm at the alarm premises shall be paid within 30 days from date of receipt thereof. Failure to make payment within 30 days from date of receipt shall result in a dis- continuance of police responses to alarms that may occur at the alarm premises . (2) The tenth false alarm shall cause the following action to occur: (a) The alarm user shall be given 10 days advance written notification that a police response will not occur when an alarm is received by the police department. SECTION 3 . This Ordinance shall become effective on the date of adoption. SECTION 4 . The consideration and adoption of this Ordinance is hereby declared to be an emergency.
