O-521-89 ORDINANCE NO. 521-89 AN ORDINANCE AMENDING SECTION 506(c) (1) AND SUB-PARAGRAPHS (1) THROUGH (8) OF SECTION 516(c) OF MIAMI SHORES VILLAGE ZONING ORDINANCE NO. 270; AUTHORIZING COMMERCIAL DISH ANTENNAE; LIMITING LOCATION AND DIMENSIONS THEREOF; PROVIDING MEANS OF MEASURING; REQUIRING SCREENING, LANDSCAPING AND LIMITING COLORS THEREOF; RENUMBERING PARAGRAPHS; PROVIDING FOR EFFECTIVE DATE. BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA: Section 1. Section 506(c) (1) of MIAMI SHORES VILLAGE Zoning Ordinance No. 270 , reads as follows : "Are approved by the Civil Aeronautics Administration of the United State Department of Commerce. " Section 2. Said Section 506(c) (1) shall stand amended to read as follows : (1) Are approved by: a. The Federal Aviation Administration; b. The Federal Communications Commission, Section 3. Section 516(c) , Sub-Paragraphs 1 through 8, inclusive, of Miami Shores Village Zoning Ordinance No. 270 reads as follows : (1) Location. Private, noncommercial dish antennae are permitted in Miami Shores Village provided they are located in the rear yard with a minimum rear setback at least equal to the antennae height, which in no event shall be less than five (5) feet, and provided they do not encroach on any other required side set- backs for the district in which located. (2) Dimensions . The height of dish antennae shall not exceed sixteen (16) feet, with a diameter not in excess of twelve (12) feet. (3) Screening. Dish antennae shall be screened by land- scaping to obscure same at ground level when viewed from abutting property. (4) Number. Only one (1) dish antenna shall be allowed for a single-family residence or townhouse unit. (5) Anchorage. All dish antennae shall be anchored se- curely to the ground in compliance with requirements of the South Florida Building Code relative to structures . (6) Permit required. No dish antennae shall be erected except on the basis of a permit issued by the Miami Shores Building and Zoning Department, and the appli- cation for said permit shall be accompanied by a site plan showing the type, color and proposed location and landscaping to be installed. (7) Maintenance. Dish antennae and related appurtenances must be maintained in good and operable condition, and the surrounding landscaping shall likewise be continuously maintained for the intended screening purpose. (8) Definition. a. Dish antenna (earth station) means a dish antenna intended for the purpose of receiving communication from orbiting satellites and other extraterrestrial sources , a low-noise amplifier (L.N.A. ) which is situated at the focal point of the receiving component for the purpose of magnifynig and trans- ferring signals , a coaxial cable for the purpose of carrying signals to the interior of a building, or a combination of any of these elements . b. Dish antenna height means the distance measured vertically from the bottom of the base (at ground level) which supports the dish antenna to its highest point when positioned for operation. Section 4. Said Section 516(c) , Sub-Paragraphs 1 through 8, inclusive, shall stand amended to read as follows : (c) A dish antenna, as hereinafter defined, when constructed in accordance with the following criteria: 1. Definitions . a. Dish antenna (earth station) .means a dish antenna intended for the purpose of receiving communications from orbiting satellites and other extraterrestrial sources , a low-noise amplifier (L.N.A. ) which is situated at the focal point of the receiving compon- ent for the purpose of magnifying and transferring signals , a coaxial cable for the purpose of carrying signals to the interior of a building, or a combina- tion of any of these elements . b. Dish antenna height means the distance measured verti- cally from the bottom of the base (at ground level) which supports the dish antenna to its highest point when positioned for operation. 2. Location. a. Ground mounted. (1) Residential dish antennae must be located in the rear yard, except, as provided for under 2(b) (3) of this section. The minimum rear setback must be at least equal to the antenna height, which in no event shall be less than five (5) feet, and provided they do not encroach on any other re- quired setbacks in a residential district. Dish antennae shall be excluded from the 15 foot setback requirement from the main building. (2) Commercial or non-commercial dish antennae, that is , those other than residential, may be ground mounted, provided they comply with setbacks in district they are located in and other provisions of these ordinances . - 2 b. Roof mounted (1) Single family residential roof-mounted dish antennae shall not be permitted. (2) Commercial dish antennae may be mounted on a commercial structure with a minimum setback from the building perimeter at the roof not less than the total height of the installed antennae. (3) Non-commercial dish antennae, including condominium structures , may be roof mounted with a minimum setback from the building perimeter at the roof not less than the total height of the installed antennae. 3. Dimensions . The height of a dish antenna shall not exceed sixteen (16) feet, with a diameter not in excess of twelve (12) feet. Where a dish antenna is erected on the roof the height thereof shall not exceed sixteen (16) feet from the roof structure where situated. 4. Screening and Color. a. Ground mounted. Where permitted, dish antennae shall be screened by landscaping and maintained to obscure same at ground level when viewed from abutting property and the public streets . b. Roof mounted. Where permitted, shall be screened in a manner so as to preclude observation of the antennae from ground level, and must be harmonious with the existing structure as per intent of Sec. 523 . c. All dish antennae shall be neutral in color. 5. Number. Only one (1) dish antenna shall be allowed for a single-family residence or townhouse unit. 6. Anchorage. All dish antennae shall be anchored securely to the ground, or, in the case of commercial antennae, roof structure, in compliance with requirements of the South Florida Building Code relative to structures . 7. Permit required. No dish antennae shall be erected except on the basis of a permit issued by the Miami Shores Building and Zoning Department, and the appli- cation for said permit shall be accompanied by a site plan showing the type, color and proposed location and landscaping to be installed. 8. Maintenance. Dish antennae and related appurtenances must be maintained in good and operable condition, and the surrounding landscaping shall likewise be continuously maintained for the intended screening purpose.
