O-516-88 ORDINANCE NO. 516-88 AN ORDINANCE AMENDING SECTION 702 OF MIAMI SHORES VILLAGE ZONING ORDINANCE NO. 270 TO INCLUDE DESIGNATION AS "HISTORIC LANDMARK" AS A CONSIDERATION IN DETERMINING AN APPLICATION FOR VARIANCE; PROVIDING EFFECTIVE DATE. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. The introductory paragraph of Section 702 of Miami Shores Village Zoning Ordinance No. 270, dealing with hardship variances, reads as follows: "If the building inspector denies an application for building permit or a certificate of occupancy for any building or use that would be in violation of any of the provisions of this ordinance, and if the applicant is of the opinion that it is impossible to apply strictly such provisions to his property because of the existence of peculiar and unusual physical con- ditions affecting such property, other than conditions relating to the financial circumstances of the applicant, he may appeal to the planning board, fully setting forth: Section 2. Said introductory paragraph shall stand amended to read as follows: "If the building inspector denies an application for building permit or a certificate of occupancy for any building or use that would be in violation of any of the provisions of this ordinance, and if the applicant is of the opinion that it is impossible to apply strictly such provisions to his property because of the existence of peculiar and unusual physical con- ditions affecting such property, other than conditions relating to the financial circumstances of the applicant, but including the fact that same has been designated as a Historic Landmark by the Miami Shores Village Council, he may appeal to the planning board, fully setting forth: Section 3.
