AN ORDINANCE AMENDING THE SCHEDULE OF REGULATIONS PERTAINING TO
PERMITTED USES IN B-1 and B-2 DISTRICTS , AS SET FORTH IN ARTICLE
IV OF THE MIAMI SHORES VILLAGE ORDINANCE NO. 270; DELETING EXPRESS
AUTHORIZATION OF PRIVATE CLUB HALL, LAUNDROMATS, THEATERS AND BUS
TERMINALS AND INCIDENTAL SIGNS AS PERMITTED IN ARTICLE V IN B-1
AND B-2 DISTRICTS; -AUTHORIZING THE SALE AND CONSUMPTION OF BEER
AND WINE UNDER LIMITED CONDITIONS IN SAID DISTRICTS; AUTHORIZING
THE SALE AND CONSUMPTION OF FOOD OUT OF DOORS IN SAID-DISTRICTS;
PROVIDING EFFECTIVE DATE.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
Section 1. Paragraphs numbered 7 thxough 12, inclusive,
of the permitted uses of B-1 zones as set forth in the Schedule
of- Regulations being 6 part of Article IV of the Miami Shores
Village Zoning ordinance No. 270 , reads as follows:
7. Laundromats, subject to the approval by the County
Health Department, and establishments for only
receiving and delivering articles for cleaning,
laundering, or dyeing.
8. Restaurants in which all service is at tables or
counters entirely within a building, but not
including any establishment, however desiganted,
in which alcoholic beverages are sold for consump-
tion on the premises.,
9 . Printing shops producing not more than 70 decibels
of noise at an boundary of the plot occupied by the
same.
10. Private club halls.
11. The following uses on approval by the Village Council
in each case, as provided in J�rticle VI :
(a) Gasoline Stations with no pumps: or base thereof
located less than 25 feet from any street line,
or closer than 500 feet from an existing gasol-ine
station.
(b) Theaters, but not including "drive-in" or open
air theaters .
(c) Bus Terminals.
(d) Pet Shops, subject to all requirements that may
be imposed by the County Health Department.
12. Incidental signs as permitted in Article V.
Section 2 . Paragraphs numbered 7 through 12 of the permitted
uses of B-1 zones as set forth in the Schedule of Regulations being
a part of Article IV of the Miami Shores Village Zoning Ordinance
No. 270, are hereby amended to read as follows:
7. in which service is provided primarily at
tables entirely within a building may also provide
service to customers outside *of the building (not in
motor vehicles) but entirely within -the boundaries of
the plot on which such restaurant is located, and only
in places designated therefor, on the site plan approved
for such use, as provided in Article VI . Restaurants
with a seating capacity of 32 table seats, or more, and
a minimum of 1000 square feet of entirely enclosed dining
area may, as an incidental part of said business, serve
beer and wine for consumption on the premises only, subject
to the following conditions, restrictions and limitations :
(a) The sale or consumptionof beer and wine at bars
or counters shall not be permitted.
(b) The principal and primary business must consist
of dispensing food.
(c) Food shall be prepared, offered and served during
all business hours.
(d) No such business shall have signs advertising
the sale of beer and wine upon the exterior thereof
or within said establishment, if same is visible
from the exterior thereof.
(e) No beer or wine shall be served during the hours
between 12 midnight one day and 11 A.M. the
succeeding day.
Section 3. Paragraph numberEd 1 of the permitted uses of
B-2 zones as set forth in the Schedule of Regulations being a part
of Article IV of the Miami Shores Village Zoning ordinance No. 270
reads as follows:
1. All uses permitted in B-1 districts, subject to all
limitations therein, except as follows :
(a) Restraurants in which service is provided primarily
at tables or counters entirely within a building
may also provide service to occupants of motor
vehicles standing entirely within the boundaries of
places designated therefor on the site plan approved
for such use, as provided in Article VI .
(b) No limitation as to intensity of noise in decibels
need be applied to any printing shop not employing
more than five persons on the premises.
,Section 4 . Paragraph numberedl of the permitted uses of
B-2 zones as set forth in the Schedule of Regulations being a part
of Article IV of the Miami Shores Village Zoning Ordinance No. 270,
shall stand amended to read as follows :
1. All uses permitted in B-1 districts, subject to all
limitations therein, except that restaurants in which
service is provided primarily at tables or counters
entirely within a building may also provide service,
except for the sale of beer and wine, to occupants of
motor vehicles stan2ring entiVely within the boundaries
of the plot on which such restaurant is located and
in places designated therefor on the site plan approved
for such use, as provided in Article VI.
Section 5. This ordinance shall be effective upon
adoption.
