O-486-85 ORDINANCE NO. 486-85 AN ORDINANCE AMENDING SECTIONS 5-2, 5-3 AND 5-6 OF THE CODE OF ORDINANCES OF MIAMI SHORES VILLAGE, FJJORIDA; ELIMINATING CONFLICT IN ,METHOD OF DETERMINING QUALIFICATIONS OF PERSONNEL OF BUILDING DEPARTMENT; ALTERING METHOD FOR REFUNDING PERMIT FEES; INCREASING PERMIT FEES; PROVIDING EFFECTIVE DATE. Section 1. Section 5-2 of the Code of Ordinances of Miami Shores Village, Florida reads as follows: "The qualifications of the Building Inspector, Plumbing Inspector, and Electrical Inspector, and other personnel of the Building Department, shall be established by the Village Manager. " Section 2. Section 5-2 of the Code of Ordinances of Miami Shores Village, Florida shall stand amended to read as follows: Reserved Section 3. The first paragraph of Section 5-3 of the Code of Ordinances of Miami Shores Village, Florida reads as follows: "No person shall erect or construct or proceed with the erection or construction of any building or structure, nor add to, enlarge, move, improve, alter, convert, extend or demolish any building or structure, or any group of buildings and/or structures under one or joint owner- ship whether on one or more lots or tracts of land; or cause the same to be done where the cost of work is fifty dollars ($50 . 00) or more in value; and on any remodel- ing or alteration job of any value; without first obtain- ing a building permit therefor from the Building Department. " Section 4 . Section 5-3 of the Code of Ordinances of Miami Miami Shores Village,Florida shall stand amended to read as follows: "No person shall erect or construct or proceed with the erection or construction of any bpilding or structure, nor add to, enlarge, move, improve, alter, convert, extend, or demlish any building or structure, or any group of buildings and/or structures under one or joint ownership whether on one or more lots or tracts of land; or cause the same to be done where the cost of work is one hundred dollars ($100. 00) or more in value; and on any remodeling or alter- ation job of any value; without first obtaining a permit therefor from the Building Department. " Section 5. Section 5-6 of the Code of Ordinances of Miami Shores Village, Florida reads as follows: (A) Double fees: When work f or which a permit is required is commenced prior to the obtaining of a permit, the fees, as specified herein, may be doubled, but in no event shall such doubled fee be less than twelve dollars and fifty cents ($12.50). The payment of such double fee shall not' relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve th'em from being subject to any of the penalties therein. The double fee requirement shall be applicable to all divisions of the building department. Minimum fee (B) Reinspection fees: When extra inspection trips are necessary due to: (1) Wrong address being given on call for inspection, (2) Prior rejection of work dueto faulty construction, (3) Work not being ready for inspection at time speci- fied, (4) Failure to call for final or other inspections, (5) Required corrections not being made or completed at time specified, a fee of ten dollars ($10.00) for each reinspection may be charged. If it is determined by the field inspector concerned, that the same job has .the same problem after the reinspection fee of ten dollars ($10.00) is assessed and paid, then a second reinspection f ee of twenty-five dollars ($25.00) shall be charged. The re- inspection fee requirement shall be applicable to all divisions of the building department. The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and. further inspections may be refused until payment of reinspection fees have been made. Reinspection fee for inspection of existing buildings by all divisions to determine compliance with the South 2 Florida Building Code, but not annual inspections as required by Section 305.1(d) shall be ten dollars ($10.00). (C) Refunds, time limitation, - cancellations: The fees charged pursuant to this schedule provided the same are for a permit required by Section 301.1 of the South Florida Building Code, may be refunded by the director of the building and zoning department, subject to the following: (1) No refund shall be made where any work has commenced except where duplicate permits are issued for the same work, in which case a refund in accordance with item (4) of this subsection may be granted to the prior issued permit holder pro- viding the duplicate permits were issued within ninety (9,0) days of each other and request for refund is received within ninety (90) days of the issuance of the latter permit. (2) Where no work, as authorized by a permit, has commenced within ninety (90) days of its issuance or within the ninety-day extension now permitted, if such extension has been officially granted, and the permit has become null and void pursuant to paragraph 304.3(a) of the South Florida Building Code, a credit of fifty (50) per cent of the original permit fee shall be applied to any reapplication fee for a permit covering the same project and in- volving the same plans, provided that the complete reapplication is made within six (6) months of the expiration date of the original permit or the ex- piration date of the ninety-day extension, if such has been granted, and provided that no refund has been made as provided in (C) (4) herein. (3) No refundg shall be made o*'n permit fees of five dollars ($5.00) orless. (4) Where no work, as authorized by a permit, .has commenced, a refund to the nearest dollar of 3 seventy (70) per cent less five dollars ($5.00) for handling pursuant to subparagraph (3) above, may be made if the applicant makes a written request therefor prior to the expiration of the permit and submits, with such request, the validated copy of the subject permit. (5) Full refunds may be granted to a permit holder whose permit is cancelled by owner authorization where work has commenced and such owner selects a second contractor to complete the work. The second contractor shall pay a full fee to complete the work unless the first contractor waives his opportunity to a refund in writing, in which case, the second contractor is entitled to a permit to cover the same work on a "no charge" basis. (6) A full refund may be granted to a permit holder who takes out a permit covering work outside the jurisdiction inspection area. (D) Building permit fee schedule: Fees listed in subsection (D) include only building permit fees and do not in- clude Plumbing, electrical, mechanical, product control, certificate of occupancy, sign permit fees or contractor/ tradesmen fees which are listed in following subsec- tions: (1) Minimum fees for building permit: Minimum fee for all building permits (items (D) (1) through (D) (16) except items (D) (5), (D) (6) and (D) (7) included in this section ____$12.50 (This minimum does not apply to add-on building permits issued as supplementary to current out- standing permits for the same job). Section 5-6 of the Code of Ordinances of Miami Shores Village, Florida shall stand amended to read as follows: (A) Double fees: When work for which a permit is required is commenced prior to obtaining of a permit, the permit applicant may be required to pay one hundred dollars ($100 .00) plus a double permit fee. In no event shall the applicant pay less than one hundred thirty dollars ($130. 00) . The payment of the required fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The double fee requirements shall be applicable to all divisions of the Building and Zoning Department as noted herein. (B) Reinspection, Lost and Revised Plans Fees 1. Reinspection: When extra inspection trips are nec- essary due to (1) wrong address being given on a call for inspection, (2) prior rejection of work due to faulty construction, (3) work not being ready for inspection at time specified, (4) failure to call for final or other inspactions, (5) required corrections not being made or completed at time specified, a fee of twenty five dollars ($25.00) for each reinspection may be charged to the permit holder in the trade concerned. If it is determined by the field inspector concerned, that the job has the same problem after the rein- spection fee is assessed and paid, then a second reinspection fee of fifty dollars ($50. 00) shall be charged. The reinspection fee requirement shall be applicable to all divisions of the Building Depart- ment. The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and further inspections may be refused until payment of reinspection fees have been made. Reinspection fee for inspection of existing build- ings by all divisions to determine compliance with the South Florida Building Code, but not annual inspections as required by 305.1 (d) shall be twenty five dollars ($25.00) per inspection. 2. Lost and Revised Pla�s: _ When plans for new build- ings and additions are lost by the owner or contractor, a recertification fee will be required to review, stamp and approve a new set of plans as a field copy. Such fee shall be based on 10 percent of the original building permit fee, with a minimum fee for Group (single family resident) of twenty five dollars ($25. 00) , and a minimum fee for all others of fifty dollars ($50. 00) Revised Plans Processing Fee: Charge for plans pro- cessing of major revisions to plans which previously were processed and permitted, such fee to be based on 30 percent of the original building permit fee, up to a maximum charge of $150 . 00 (Minimum Fee applies) . _19- Lost Permit Card Fee: Charge for the loss of a Permit Inspection Record Card after a permit has been issued. A replacement fee of $10.00 for the loss of each card shall be charged. C. Refunds, Time Limitation, Cancellations: The fees charged pursuant to this schedule provided the same are for a permit required by Section 301.1 of the South Florida Building Code,may be refunded by the Director of the Building and Zoning Department, subject to the following: 1. No refund of permit fees shall be made on requests involving the following: (a) Permit fees of $50 . 00 or less. (b) Permits cancelled by court order or revoked by the building official under authority granted by the South Florida Building Code. (c) Expired permits (d) Permits under which work has commenced as evidenced by any recorded inspection made by the Building Department. 2. A full refund of permit fees shall be allowed when a permit is issued for work outside the jurisdictional inspection area. 3. A full refund of permit fee, less $50 . 00 or 30% of the permit fees, whichever is greater, rounded to the nearest dollar, shall be allowed to a permit holder who files a written request therefor prior to the expiration date of the permit, provided no work has commenced under said permit as evidenced by any recorded inspection. The refund application must be accompanied by applicant' s validated copy of said permit. 4. Where there is a change of contractorinvolving a permit for which a fee of more than $50. 00 was paid to the Building Department, the original permit holder is not entitled to any refund if the permit has expires, or if work has commenced under such permit as evidenced by any recorded inspection. However, upon the issuance of a permit to a second permit holder, the original permit holder is entitled to a full refund where the permit has not expired and no work has commenced under said permit as evidenced by any recorded inspection. The second permit holder shall pay a full fee if the original permit has expired, or shall pay $75. 00 to cover the cost of transferring the data from the original to the second permit in instances where work has commenced under the original unexpired per- mit as evidenced by any recorded inspection. The second permit holder shall pay a full fee plus $75. 00 to cover the transferring and reprocessing costs where no work has commenced under the original unexpired permit, as evidenced by any recorded inspection. 20 5. A fee of $30 . 00 shall be paid by the permit holder who submits a written request for a permit extension as authorized under Section 304. 3 (b) of the South Florida Building Code. 6. Where a permit has become null and void pursuant to paragraph 304.3 (a) of the South Florida Building Code, andno work, as evidenced by at least one recorded inspection, has been made by the Department, a credit of fifty percent (50%) of the original permit fee shall be applied to any reapplication fee for a permit covering the same project and involving the same plans, provided that the complete reapplication is made within six (6) months of the expiration date of the original permit, and provided that no refund has been made as provided in this Section. The permit reapplication must be submitted with the plans and the applicant' s validated copy of the original permit. The amount of this fee shall be at least equal to or higher than the minimum fee for the trade concerned. D. Building Permit Fees: The Building and Zoning Director authorized to charge the fees which were in existence prior to the effective date of this amended fee schedule for those sub-contract permits, i.e. , electrical, plumbing, mechanical, etc. , where the master building permit was issued prior to the effective date of this amended fee schedule, and where written evidence such as aksigned and dated copy of the sub-contract is submitted to sutstantiate the fact that the sub-contract was entered into prior to the effective date of this amended fee schedule. Fees listed in Subsection (D) hereunder include only building permit fees and do not include plumbing, electrical, mechanical, product control, certificate of occupancy, sign permit fees or contractor/tradesmen fees which are hereinafter set forth in other sub-sections: 1. Special Projects: A fee equal to actual staff time and related costs shall be assessed for special projects requiring research by the Department in order to answer questions proposed by developers, attorneys, realtors, or municipalities, etc. , in connectionwith the use, resubdivision, and develop- ment of properties, or to determine if any existing violations are on the property through a review of departmental records. Such special fees only will be levied for requests outside the scope of normal Departmental work. A minimum fee of $20. 00 shall be charged. 2.
