O-474-85 ORDINANCE NO. 474-85 AN ORDINANCE AMENDING PARAGRAPH (c) OF SECTION 516- OF MIAMI SHORES VILLAGE ORDINANCE NO. 270; DEFINING AND AUTHORIZING DISH ANTENNA&; LIMITING NUMBER, SIZE AND LOCATION THEREOF; REQUIRING SCREENING., MAINTENA14CE AND PERMIT; EXCEPTING CERTAIN DISH ANTENNAS; PROVIDING SEVER.ABILITY CLAUSE AND EFFECTIVE DATE. BE IT ORDAINED BY* MIAMI SHORES VILLAGE: Section 1. Section 516 (c) of Miami Shores Village Ordinance No. 270 reads as follows: "Accessory buildings shall be deemed to include the following or any combination thereof: (a) . . . (b) . . . (c) Reserved. (d) . . . (e) . . . .but no accessory building shall contain any housekeeping facilities or sleeping accommodations. No metal utility shed shall contain electric, water or telephone service, and shall not be used for a commercial purpose. " Section 2. That paragraph (c) of Section 516 'of Miami Shores Village Oi—dinance No. 270 shall stand amended to read as follows: "Section 516. Accessory buildings shall be deemed to include the following or any combination thereof: (a) . . . (b) . . . (c) A dish antenna, as hereinafter defined, when constructed in accordance with the following criteria: (1) LOCATION - Private, non-commercial dish antennas are permittedin Miami Shores Village provided they are. located in the rear yard with a minimum rear setback at least equal to the antenna height, which in no event shall be less than five feet, and provided they do not encroach on any other required side setbacks for the district in which located. (2) DIMENSIONS - The height of dish, antennas shall not exceed ,16 feet, with a diameter not in excess of 12 feet. (3) SCREENING - Dish antennas shall be screened by landscaping to obscure same at ground level . g when viewed from abutting property. (4) NUMBER - Only one dish antenna shall be allowed for a single family residence or townhouse unit. (5) ANCHORAGE - All dish antennas shall be anchored securely to the ground in compliance with requirements of the South - Florida Building Code relative to structures. (6.) PERMIT REQUIRED - No dish antennas shall be erected except on the basis of a permit issued by the Miami Shores Building and Zoning Department, and the application for said permit shall be accompanied by a site plan showing the type, color and proposed—location and landscaping to be installed. (7) MAINTENANCE - Dish antennas, and related appurtenances must be maintained in good and operable condition, and the . surrounding landscaping shall likewise be continuously maintained for the -intended screenin I g purpo I se. (8) DEFINITIONS (a) DISH ANTENNA (earth station) means a dish antenna intended for the. purpose of receiving communication from orbiting satellites and other extraterrestrial sources, a Low-Noise Amplifier (L.N.A. ) which is situated at the focal point of the receiving component for the purpose of magnifying and transferring signals, a coaxial cable for the purpose of carrying signals to the interior of a building, or a comindtion of any of these elements. (b) DISH ANTENNA HEIGHT means the distance measure d vertically from the bottom of the base (at ground level) which sup- ports the dish antenna to its highest point when positioned for operation. (9) EXCEPTIONS - Any private, non-commercial, dish ,antenna existing upon passage of this ordinance, if same complies* with the criteria hereinabove set forth, upon the condition that a building permit has been issued therefor 'or- is obtained within thirty (30) days of the adoption of this ordinance. but no accessory building shall contain any house- keeping facilities or sleeping accommodations. No metal utility shed shall contain 6lectric, water or telephone service, and shall not be used for a com- mercial purpose. " Section 3. If any word, clause, phrase, sentence, paragraph or section of this ordinance is held to be invalid by a court of competent jurisdiction, such declaration of invalidity shall not affect any other work, clause, phrase, sentence, . paragraph- or section of this ordinance. Section 4.
