AN ORDINANCE ESTABLISHING A DOWNTOWN REVITAL-
IZATION BOARD, SETTING ITS ORGANIZATION , POWERS
AND DUTIES, SETTING FUNDING PROCEDURES , PROVID-
ING SEVERABILITY AND AN EFFECTIVE DATE .
BE IT ORDAINED BY MIAMI SHORES VILLAGE :
Section 1 . PURPOSE - The purpose of this ordinance
is to establish a Downtown Revitalization Board
to plan and oversee revitalization efforts in the
existing business district contiguous to N . E. 2nd
Avenue.
Section 2 . DEFINITIONS
a. Comprehensive Plan - The Village Plan prepared
under the requirements of the Local Government
Comprehensive Planning Act of 1975 (FS 163.3161 ) .
b. Local Planning Authority - The Village Planning
Board ( FS 163 . 3174 and Sec . 18-7 . 1 Miami Shores
Village Code of Ordinances ) .
c . Main Street Program - The Florida Main Street
Program administered by the Florida Bureau of
Historic Preservation .
d . Master Plan - An area revitalization plan to be
prepared by the Downtown Revitalization Board
and to be considered for incorporation into the
Comprehensive Plan as an "area redevelopment
element" (FS 163 . 3177 (h) ) .
e. Village Planning Board - The Board established by
Chapter 18, Miami Shores Code of Ordinances in
accordance with FS 163 . 180.
Section 3 . ORGANIZATION
a . The Downtown Revitalization Board shall consist
of seven members appointed by the Village Council .
The terms of office of the board members shall be
four years except that the initial board shall
have two members appointed for one-year terms ,
two for two-year terms , two for three-year terms
and one for a four-year term. A vacancy occurring
during a term shall b.e filled for the unexpired
term . Each board member shall hold office until
his successor is appointed .
b. Each member appointed to the board shall serve
only so long as he resides in Miami Shores Village
or is engaged in business , which shall mean owning
a business , practicing a profession , or performing
a service for compensation , or serving as an
officer or director of a corporation or other
business entity so engaged, within Miami Shores .
At least five of the seven members shall be
residents .

c. The board shall adopt and promulgate rules

governing its procedures subject to approval
of the Village Council and shall hold meetings
on a regularly specified date no less than
once a month . Public notice shall be made of
all meetings of the board and all meetings shall
be open to the public . Minutes of the meetings
shall be duly recorded and presented to the
Village Clerk for distribution to the Village
Council . Members of the board shall serve
without compensation.
d . The board shall annually select a chairman and
vice-chairman according to its rules .
e. Any member of the board may be removed at any
time by a majority vote of the Village Council .
f. The board shall be authorized to work with a
professional project manager who shall serve as
an independent contractor and not an employee
of Miami Shores Village and who shall be engaged
by a contract entered into by the Village Manager
upon the recommendation of the board .
g . The board shall submit an annual budget request
to the Village Manager by June 15 each year.
The Village Council shall annually appropriate
for the board such amounts as the Council deems
necessary for the administrative expenses and
overhead of the board . With the approval of the
Village Council the board may solicit grants ,
contributions , and other forms of financial and
"in kind " assistance from the Federal Government ,
the State , County , or other public body or from
any source public or private for the purpose of
furthering the work of the board. All funds of
the board shall be handled in accordance with
the normal financial procedures of the Village.
h . The board may appoint non-voting , non-paid special
advisors to the board to assist in its work.
Section 4. POWERS AND DUTIES
a . Upon Village Council approval the board shall
have responsibility for the implementation of
the "Main Street" program in the event Miami
Shores is selected to participate in the Florida
Main Street Program.
b . The board shall develop a master plan for the
existing N . E. 2nd Avenue business district .
This plan shall be submitted to the Local Planning
Authority and the Village Council for consider-
ation for inclusion as an element of the Village
Comprehensive Plan in accordance with FS 163. 3184.
As a minimum the plan shall include :
(1 ) Quality and design standards , to include
colors and materials , for improvement or
development for all property within the
district.
(2 ) Sign regulations and requirements within
the district .

(3) Special parking regulations and require-
ments within the district.
(4) Height and density requirements and
limitations within the district.
(5) Landscaping standards and requirements
within the district.
(6) Land uses within the district.
c . The board shall assist the Village Planning Board ,
when requested by the Planning Board , in prep-
aration of any changes to the zoning regulations
necessary to implement changes to the Compre-
hensive Plan.
d . The board may review all applications for building
permits , variances or land use changes involving
property in the N . E . 2nd Avenue Business District.
Such reviews shall be completed in a timely manner.
The Village Planning Board shall consider the
recommendations of the board on all matters brought
before the Planning & Zoning Board . involving the
N . E . 2nd Avenue Business District.
e . The board shall explore avenues to increase
private participation in the downtown revital -
ization process , including participation of a
private non-profit corporation to assume respon-
sibility and funding for revitalization efforts .
f. In February each year the board shall submit a
report to the Village Council covering activities
of the preceding year and plans for the follow-
ing year.
Section 5 . SEVERABILITY
If any section , sub-section , sentence , clause or
provision of this ordinance is held invalid , the
remainder of this ordinance shall not be affected
by such invalidity .
Section 6. This ordinance shall become effective
when adopted .
