ORDINANCE NO . 460-83
AN ORDINANCE AMENDING ARTICLE III , SECTIONS 15-46 ,
SECTION 15-47 and SECTION 15-49 , CODE OF ORDINANCES ,
MIAMI SHORES VILLAGE , FLORIDA; ELIMINATING CERTAIN
MEMBERSHIP RESTRICTIONS IN THE MIAMI SHORES COUNTRY
C L U B .
BE IT ORDAINED BY MIAMI SHORES VILLAGE :
Section 1 . Article III , Sections 15-46 , 15-47 and
15-49 , Code of Ordinances , Miami Shores Village , Florida , read
as follows :
Sec. 15-46. Definitions.
As used in this article the following
terms shall have the respective meanings
ascribed to them:
Nonowner resident : A person who resides
in the village but does not own a parcel
of property in the village . For the purposes
of this definition a person shall be deemed
to reside in the village if he occupies a
residential unit in the village under a
written lease ; has continuously occupied the
same for a period of eighteen ( 18) consecu-
tive months immediately preceding his applica-
tion for membership in Miami Shores Country
Club ; has established the village as his
residence ; and has registered to vote in
municipal , county , state and national elec-
tions , giving such address as his residence ;
but temporary absences from the property
shall not destroy continuous occupancy ,
provided the property is not turned over to
the possession of another person under a sub-
lease or an assignment of lease or-- returned
to the lessor.
Nonresident : A person who does not own a
parcel of property in the village and does
not reside in the village .
Nonresident owner : A person who owns a
parcel of property in the village but does
not reside in the village.
Parcel of property : A residential or commer-
cial building site of sufficient size to permit
construction thereon of a residence , apartment
building or commercial building in accordance
with the provisions of the village Code ,
ordinances , regulations and resolutions per-
taining thereto. For the purposes of this defi -
nition , a condominium dwelling unit shall be
deemed a parcel of property .
Resident owners : A person who owns a parcel
of property In the village and resides in the
village. If any parcel of property is owned
and occupied by more than one person , the right
to membership hereunder shall be limited to
one of said persons . If any parcel of property
is owned and occupied by a corporation , the
right to membership hereunder shall be limited
to either the president or the chairman of the
board of directors of said corporat-ion , and
shall be limited to one membership. (Ord . No.

Sec. 15-47. Golf membership-Elibibility conditions .
The following persons , and no others , shall
be eligible for one ( 1 ) golf membership at the
Miami Shores Country Club , subject to the pay-
ment of such dues or fees as may from time to
time be established by the council , and all
ordinances of the village , and the rules and
regulations of the Miami Shores Country Club :
( 1 ) A resident owner.
(2) A nonresident owner.
(3) A nonowner resident .
Sec. 15-49. Eligibility for social or tennis
membership.
The following persons , and no others , shall
be eligible for social or tennis memberships
subject to the payment of such fees as may from
time to time be established by the council , and
in compliance with such other rules and regula-
tions as may from time to time be established
by the council :
( 1 ) A resident owner.
(2) A nonresident owner.
(3) A nonowner resident .
A person leasing and occupying commercial
property within the municipal limits of Miami
Shores shall be eligible for a social membership .
A maximum of two (2) persons per lease shall be
eligible for social membership , and in the case
of a corporate lessee a maximum of two (2)
persons occupying the ]eased premises , to be
designated by the chief executive officer of
the corporation , shall be eligible for social

Section 2. Article III , Sections 15-46, 15-47 and 15-49 ,
Code of Ordinances , Miami Shores Village , Florida , are hereby
amended to read as follows :
Section 15-46. Membership.
The Village Council shall from time to time
determine and adopt by resolution the various
categories , qualifications for membership
and fees , as needed .
Section 15-47. Reserved .
Section 15-49 . Reserved .
Section 3. This ordinance shall become effective on
the date of adoption .
