O-433-81 ORDINANCE NO, 433-81 AN ORDINANCE AMENDING SECTION 225 AS AMENDED BY ORDINACE NO. 403�78, AND SECTION 516, AS AMEND- ED BY ORDINANCE 409-79, OF ORDINANCE NO. 270, THE ZONING ORDINANCE OF M.IAMI SHORES VILLAGE, TO ESTABLISH NEW REGULATIONS FOR TRELLISES, ARBORS, AND PERGOLAS. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1 That Section 225, as amended by Ordinance No. 403-78, is as follows: Sectfon 225 Masonry construction: Constructi,on of all exterior walls, and all structural elements of a building with stone, cement, or cement products , bri,ck, or tile, and the roof thereof with fire-resiStinglLor ,non- combustible materfal . All roofs with inclines or not less than 2-1/2 inches per foot, and all mansard facias, shall be of the following -materials: 1 . Clay Tile. 2. White concrete tile. 3. Solid colored cement tile which color is impregnated with the same color Jntensity throughout. 4. Thick butt variegated slate. with the following exceptions: (a) Door and window spaces may be trimmed and in any material . (b) Any porch, so long as it remains unenclosed, may be framed in wood construction of a structural strength not less than that requi,red for comparable parts of the remainder of the building. (c) A carport, every part of which is situated to the rear of the building and between the prolongations of the side lines thereof, may be of other than the foregoing construct- ion, provided that all parts of such carport except any fabric covering, shall be of a structural strength not less than that required for comparable parts of the main building. (d) A covered passageway, with sides unenclosed, between a main building and an accessory building may be constructed of other than the materials first listed above. (e) Flat roofs are permitted on additions to existing pitched- roof structures providing: (1 ) A cement or tile roof is not practical , and this shall be determined by the Planning Board. (2) This addition shall not exceed 15% of the ground area of the existing building. (3) The addition is not visible from the front elevation of the building on an inside lot, or is not visible from the front or side streets elevations on a corner lot. (f) All roofs having an incline of less than 2-1/2 inches per foot shall be constructed of built-up roofing material and gravel and shall require the approval of the Planning Board as being harmonious with other buildings in the proximity thereof. Section 2. That Section 225, as amended by Ordinance No. 403-78 shall become, and the same is hereby amended to include the foregoing section with the addition of paragraph (g) , as follows: (g) Trellises, arbors, and pergolas: A heavy framework of cross timbers in an ornamental openword construction of woods serving as a protective screen, not to exceed in height the roof eave line on a single story residence to which it is attached, or not to exceed 10 ft. in height on a detached structure; in rear yards not to exceed more than 20% of the area of the yard; with minimum setbacks as follows: front yard 25 ft. , side yard 10 ft. and rear yard 5 ft. , to be designed by a registered architect and constructed of one of the following: pressure treated Southern pine, cedar or redwood; with minimum timbe.r, �.izes as follows: (a) support columns - 4" wide x 4" deep, (b) matn support beams - nominal cross section of 16 square inches. Section 3. That Section 516, as amended by Ordinance No. 409-79, i's as follows: Section 516. Accessory buildings shall be deemed to include the following or any combination thereof: (a) pri'vate garages, carports, garden tool houses and similar buildings; (b) children's playhouses; (c) pergolas and trellises; (d) structures for raising plants, subject to approval by the Planning Board for any such structure exceed- ng 80 square feet i,n area of ground coverage; (e) utility sheds. Notwithstanding any other provisions of this ordinance, utility sheds may be constructed of metal provi'ded they do not exceed 120 square feet in size and that a permit is obtained from Miami Shores Village prior to the erection thereof: but no'-. accessory building shall contain any housekeeping facilities or sleepi,ng accommodations. No metal utility shed shall contain electric, water, or telephone service and shall not be used for a commercial purpose. Section 4. That Section 516, as amended by Ordinace No. 409-79, be further amended by elimi,nating paragraph (c) pergolas and trellises, from the list of accessory buildings. In all oth6r respects Section 516 will remain i*n effect with paragraph (c) to be held in reserve. PASSED on first reading this 6th day of October, 1981 .
