O-431-81 ORDINANCE NO. 431-81 AN ORDINANCE REPEALING ORDINANCE NO. 428-81, WHICH ESTABLISHES THREE MONTHS MORATORIUM ON SITE PLAN APPROVAL WHERE PARKING DOES NOT COMPLY WITH CODE; DECLARING EMERGENCY AND PROVIDING EFFECTIVE DATE. WHEREAS, investigation has shown that the parking facilities of Miami Shores Village no longer require a moratorium on site plan approvals where parking does not comply with the Miami Shores Village Code, and WHEREAS, it is contemplated that any needed or desirable amend- ments to the existing zoning ordinance can be achieved in due course without the continuation of the existing moratorium established by Miami Shores Village Ordinance No. 428-81, THEREFORE BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. Section 1 of Miami Shores Village Ordinance No. 428-81 reads as follows: "Section 1. That for a three months period from the date of the adoption of this ordinance there shall be no site plan approval for any applicant based upon a change of use, unless the premises involved comply with the parking requirements required of new structures under Village ordinances." Section 2. Section 2 of said Ordinance declares same to be an emergency measure, and Section 3 thereof provides an effective date. Section 3. Miami Shores Village ordinance No. 428-81 is hereby repealed. Section 4. This Ordinance is declared to be an emergency measure. Section 5. This Ordinance shall become effective upon adoption.
