O-426-81 ORDINANCE No. 426-81 AN ORDINANCE AMENDING SUB-SECTION (b) OF SECTION 34, ARTICLE II, OF CHAPTER 17, OF THE CODE OF ORDINANCES, MIAMI SHORES VILLAGE, FLORIDA; ESTABLISHING ONE YEAR LIMITATION ON OPTION TO RECEIVE CREDIT FOR PRIOR SERVICE FORFEITED BY ACCEPTING REFUND OF CONTRIBUTION; PROVIDING EFFECTIVE DATE. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. Sub-section 17-34 (b) of Article II of the Code of ordinances, Miami Shores Village, Florida presently reads as follows: " (b) Any member receiving a refund of contributions shall thereby forfeit and relinquish all accrued rights in the plan, including all accumulated credit- able service; provided, if any member who has with- drawn his contributions as provided for in this section shall re-enter the service of the village, and again become a member of the plan, he may restore all moneys previously received by him as a refund, including regular interest for the period of his absence from the village service, and he shall then again receive credit for service which he forfeited by the accept- ance of such refund. Such restoration shall be permitted only if a member shall have rendered at least two (2) years of continuous service following his latest re-entry into the service of the Village during which he shall have made contributions to the plan. " Section 2. Sub-section 17-34 (b) of Article II of the Code of ordinances, Miami Shores Village, Florida shall become and the same is hereby amended to read as follows: (b) Any member receiving a refund of contributions shall thereby forfeit and relinquish all accrued rights in the plan, including all accumulated creditable service; provided, if within one year of said forfeit- ure any member who has withdrawn his contributions as provided for in this section shall re-enter the ser- vice of the village, and again become a member of the plan, he may restore all moneys previously received by him as a refund, including regular interest for the period of his absence from the village service, and he shall then again receive credit for service which he forfeited by the acceptance of such refund. Such restoration shall be permitted only if a member shall have rendered at least two (2) years of continuous service following his latest re-entry into the service of the village during which he shall have made contribu- tions to the plan. Section 3. This ordinance shall become effective on the date of adoption.
