AN ORDINANCE AMENDING SUB-SECTION (b) OF SECTION 29, ARTICLE II,
OF CHAPTER 17, OF THE CODE OF ORDINANCES, MIAMI SHORES VILLAGE,
FLORIDA; PROVIDING OPTION TO VILLAGE MANAGER, VILLAGE CLERK,
AND VILLAGE ATTORNEY TO EXCLUDE THEMSELVES FROM MEMBERSHIP OF
THE MIAMI SHORES VILLAGE PENSION PLAN; PROVIDING EFFECTIVE DATE.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
Section 1. Sub-section 17-29 (b) of Article II of
the Code of Ordinances, Miami Shores Village, Florida presently
reads as follows:
11 (b) Any person who becomes an employee after
the effective date shall, upon completion of
one (1) year of continuous service, become a
member of the plan as a condition of employment,
provided said person is at least twenty-one (21)
years of age and under fifty-one (51) years of
age at the time of completion of said one (1) year
of service. Contributions by such employee under
this plan shall begin with the first payroll period
after the age and service requirements shall have
been fulfilled, and creditable service shall then
begin to accrue. "
Section 2. Sub-section 17-29 (b) of Article II of
the Code of Ordinances, Miami Shores Village, Florida shall
become, and the same is hereby amended to read as follows:
" (b) Any person who becomes an employee after the
effective date shall, upon completion of one (1)
year of continuous service, become a member of the
plan as a condition of employment, provided said
person is at least twenty-one (21) years of age and
under fifty-Qne (51) years of age at the time of
completion of said one (1) year of service.
Contributions by such employee under this plan shall
begin with the first payroll period after the age and
service requirements shall have been fulfilled, and
creditable service shall then begin to accrue. It
shall be optional with all Village employees who
serve at the will of the Village Council, including
but not limited to the Village Manager, Village Clerk
and Village Attorney, to be excluded from the Village
Pension Plan by filing with the Pension Board written
request for exclusion prior to completion of one (1)
year of service. Provided, nevertheless, that any
employee presently serving at the will of the Council
shall have sixty days from the date of adoption of this
ordinance within which to elect to be excluded. "
Section 3. This ordinance shall become effective
on the date of adoption.
PASSED AND ADOPTED on first reading on the l6th
day of DECEMBER 1 1980.
PASSED AND ADOPTED on final reading on the 6th
day of JANUARY 1981.
