O-419-80 ORDINANCE No. 419-80 AN ORDINANCE AMENDING CHAPTER 13, ARTICLE I, SECTION 1, OF THE CODE OF ORDINANCES, MIAMI SHORES VILLAGE, FLORIDA; FINDING NEED FOR ORDINANCE LIMITING HOURS OF RETAIL SALE OF CONSUMER GOODS; ESTABLISHING LIMITED HOURS FOR RETAIL SALE OF CONSUMER GOODS; PROVIDING EFFECTIVE DATE. WHEREAS, it is the finding of this Council, following public hearings and inquiry that the unrestricted sale of consumer goods in this municipality does constitute both a private and public nuisance, and WHEREAS, there appears to be a need to limit the hours of said retail sales to preclude an unreasonable breach of the peace and tranquility of this municipality, THEREFORE BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. Section 13-1 of Article 1, Chapter 13, of the Code of ordinances of Miami Shores Village, Florida, presently reads as follows: "Sec. 13-1. No person shall, within the limits of Miami Shores Village, engage in or manage any business, occupation or profession without first having paid the amount of license tax required hereby and with,lut first having obtained a village occupational license therefor issued for and apply- ing to the current occupational license year, or fractional part thereof, during which such business, occupation or profession is commenced, carried on or engaged in. Such occupational license shall be applied for and obtained before the commencement of any such business, occupation or profession, and annually thereafter on or before October Ist of each year as long as such business, occupation or profession is carried on." Section 2. Section 13-1, Article I of Chapter 13, of the Code of ordinances, Miami Shores, Village, Florida, shall become, and the same is hereby amended to read as follows: "Sec. 13-1. No person shall, within the limits of Miami Shores Village, engage in or manage any business, occupation or profession without first having paid the amount of license tax required hereby and without first having obtained a village occupational license therefor issued for and applying to the current occupational license year, or fractional part thereof, during which such business, occupation or profession is commenced, carried on or engaged in. Such occupational license shall be applied for and obtained before the commence- ment of any such business, occupation or profession, -2- and annually thereafter on or before October 1st of each year as long as such business, occupation or profession is carried on. Pro- vided, nevertheless, that the retail sale of consumer good between the hours of one o 'clock, a.m. , and six o'clock a.m. is prohibited. " Section 3 . This ordinance shall become effective on the date of adoption. PASSED on first reading this 19th day of August , 1980. PASSED and ADOPTED on the -2nd day of September 1980.
