O-402-78 ORDINANCE NO. 4n9_7g AN ORDINANCE AMENDING SECTION 11-12 OF MIAMI SHORES VILLAGE CODE OF ORDINANCES BY ADDING A PARAGRAPH AUTHORIZING A LIEN ON PRIVATE PROPERTY TO SECURE PAYMENT OF CHARGES FOR VILLAGE SERVICES . BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. Section 11-12 of the Code of ordinances of Miami Shores Village provides as follows: (a) It shall be unlawful for the owner of land in Miami Shores Village to permit vegetation of any kind, including trees, plants, shrubs, or vines to grow upon said land to the extent that said vegetation extends into the right-of-way of persons and vehicles lawfully travelling upon the public sidewalks, streets, and alleys of this municipality. (b) It shall be unlawful for any person to occupy land in Miami Shores Village which land is in violation of the foregoing subsection. Section 2. Section 11-12 of the Code of Ordinances of Miami Shores Village shall become, and the same is hereby amended to read as follows: (a) it shall be unlawful for the owner of land in Miami Shores Village to permit vegetation of any kind, including trees, plants, shrubs, or vines to grow upon said land to the extent that said vegetation extends into the right-of-way of persons and vehicles lawfully travelling upon the public sidewalks, streets, and alleys of this municipality. (b) It shall be unlawful for any person to occupy land in Miami Shores Village which land is in violation of the foregoing subsection. (c) In the event of non-compliance with paragraph (a) above, the village may cut and remove the said vegetation growing in violation of this Section, and an appropriate additional fee for the cutting and removing of said vegetation shall be made by the Village and shall constitute a lien against the offending premises to the same extent and character as the lien for special assessment, and with the same penalties, and with the same rights of collection, foreclosure, sale and forfeiture as obtained for special assessment liens, and may be handled in the same manner by the Village. Prior to assessing a special fee, as provided for in this section, the Village Manager, or his designee, shall give notice to the owner and occupant of such property to comply with this section within ten (10) days after the service of such notice. The manner of providing the required notice to owner and occupant shall be the same as set forth in Section 11-3 hereof. Section 3. This ordinance shall take effect immediately upon its passage.
