AN ORDINANCE AMENDING AND RE-ENACTING THE PROVISIONS OF
ORDINANCE NO. 287 OF MIAMI SHORES VILLAGE, ADOPTING THE
SOUTH FLORIDA BUILDING CODE AS THE BUILDING CODE OF MIAMI
SHORES VILLAGE AND FOR OTHER PURPOSES.
BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA: THAT
ORDINANCE NO. 287 OF MI0,I SHORES VILLAGE BE AMENDED ND
RE-ENACTED 30 THAT THE SAME SHALL READ AS FOLLOWS:
SECTION 1. ADOPTION OF BUILDING, PLUMBING,' ELECTRICAL AND RELATED
TECHNICAL CODES.
The document marked, designated, and known as the "South Florida
Building Code," which is made a part hereof by reference, is hereby adopted
as a minimum standard for the purposes expressed therein and shall be known
as the "Building Code of Miami Shores Village." and this document shall be
as fully effective as though every word, phrase, sentence, or section of the
South Florida Building Code were fully incorporated herein, except as modified
or added to in sections of this ordinance which follow.
SECTION 2. AUTHORITY.
Wherever the terms "Building Official",, "Plumbing Inspector",
"Electrical Inspector", "Jurisdiction", "Regulatory Authority",, or similar
terms shall appear, they shall refer to the properly designated inspectors or
assistant inspectors of the Building Department of Miami Shores Village, and
to the authority and jurisdiction of Miami Shores Village and its officials
and employees.
SECTION 3. QUALIFICATIONS OF INSPECTORS AND PERSONNEL.
The qualifications of the Building Inspector, Plumbing Inspector,
and Electrical Inspector, and other personnel of the Building Department,
shall be established by the Village Manager,

SECTION 4. APPLICATION FOR BUILDING PERMITS.
No person shall erect or construct or proceed with the erection or
construction of any building or structure, nor add-to, enlarge, move, improve,
alter, convert, extend or demolish any building or structure, or any group of
buildings and/or structures under one or joint ownership whether on one or
more lots or tract of land; or cause the same to be done where the cost of
work is fifty dollars ($50.00) or more in value; and on any remodeling or altera-
tion job of any value, without first obtaining a building permit from the Build-
ing Department.
SECTION 5. BUILDING PERMIT FEES.
The office of the Building Department of Miami Shores Village, shall
charge and collect for building permits at the following rates, to wit:
A. DOUBLE FEES:
When work for which a permit is required is commenced prior
to the obtaining of a permit, the fees, as specified herein,
may be doubled, but in no event shall such doubled fee be
less than twelve dollars and fifty cents ($12.50) . The pay-
ment of such double fee shall not relieve any person, firm
or corporation from fully complying with all of the require-
ments of all applicable regulations and codes, nor shall it
relieve them from being subject to any of the penalties therein.
The double fee requirement shall be applicable to all divisions
of the Building Department.

B. REINSPECTION FEES:
When extra inspection trips are necessary due to (1) wrong
address being given on call for inspection, (2) prior rejec-
tion of work due to faulty construction, (3) work not being
ready for inspection at time specified, (4) failure to call
for final or other inspections, (5) required corrections not
being made or completed at time specified, a fee of ten dollars
($10.00) for each reinspection may be charged. If it is deter-
mined by the field inspector concerned, that the same job has
the same problem after the reinspection fee of ten dollars
($10.00) is assessed and paid, then a second reinspection fee
of twenty-five dollars ($25.00) shall be charged. The re-
inspection fee requirement shall be applicable to all divisions
of the Building Department.
The payment of reinspection fees may be required before any
further permits will be issued to the person or firm owing
same, and further inspections may be refused until payment of
reinspection fees have been made.
Reinspection fee for inspection of existing buildings by all
divisions to determine compliance with the South Florida Build-
ing Code, but not annual inspections as required by 305.1(d)
shall be ten dollars ($10.00).

C. REFUNDS, TIME LIMITATION, CANCELLATIONS:
The fees charged pursuant to this schedule provided the same
are for a permit required by section 301.1 of the South Florida
Building Code, may be refunded by the director of the Building
and Zoning Department, subject to the following:
(1) No refund shall be made where any work has commenced ex-
cept where duplicate permits are issued for the same work,
in which case a refund in accordance with item (4) of this
sub-section may be granted to the prior issued permit holder
providing the duplicate permits were issued within ninety
(90) days of each other and request for refund is received
within ninety (90) days of the issuance of the latter permit.
(2) Where no work, as authorized by a permit, has commenced with-
in ninety (90) days of its issuance or within the ninety-
day extension now permitted, if such extension has been
officially granted, and the permit has become null and void
pursuant to paragraph 304.3(a) of the South Florida Building
Code, a credit of fifty per cent (50%) of the original permit
fee shall be applied to any reapplication fee for a permit
covering the same project and involving the same plans, pro-
vided that the complete reapplication is made within six (6)
months of the expiration date of the original permit or the
expiration date of the ninety-day extension, if such has been
granted, and provided that no refund has been made as pro-
vided in (C) (4),, herein.
(3) No refunds shall be made on permit fees of five dollars
($5.00) or less.
(4) Where no work, as authorized by a permit, has commenced, a
refund to the nearest dollar of seventy per cent (70%) less
five dollars ($5.00) for handling pursuant to subparagraph
(3) above, may be made if the applicant makes a written re-
quest therefor prior to the expiration of the permit and sub-
mits, with such request, the validated copy of the subject per-
mit.
(5) Full refunds may be granted to a permit holder whose permit
is cancelled by owner authorization where work has commenced
and such owner selects a second contractor to complete the
work. The second contractor shall pay a full fee to complete
the work unless the first contractor waives his opportunity
to a refund in writing, in which case, the second contractor
is entitled to a permit to cover the same work on a "no charge"
basis.
(6) A full refund may be granted to a permit holder who takes out
a permit covering work outside the jurisdiction inspection
area,

not include plumbing, electrical, mechanical, product control, certifi-
cate of occupancy, sign permit fees or contractor/tradesmen fees which
are listed in following sections:

SECTION 6. ZONING ORDINANCE.
Before any permit is issued, all provisions of the Miami Shores Village
Zoning ordinance No. 270, and any amendments thereto shall be complied with,, and
the provisions of the Building Code shall not be construed to repeal,, supersede,
or modify any part of the said Zoning Ordinance No. 270 or amendments thereto.
SECTION 7. PENALTIES.
Any person convicted for violating any of this ordinance shall, upon
conviction thereof in a Court of competent jurisdiction, be sentenced to pay
a fine not exceeding the sum of Five Hundred Dollars ($500.00) or serve a term
not to exceed sixty days in the County jail, or both such fine and sentence in
the discretion of the Court.
SECTION 8. SEPARATE OFFENSES.
Each day's violation of any of the terms of this ordinance shall be
deemed and considered and is hereby specially declared to be a separate and
distinct violation of the terms of this ordinance and punishable as such.
SECTION 9. SEPARABILITY.
In the event that any portion of this ordinance shall be held to be
void, inconsistent or of no effect by a Court of competent jurisdiction, such
holding shall in no wise affect or disturb the remaining portions of this ordinance.

SECTION 10.
All ordinances in conflict or inconsistent herewith are hereby
repealed insofar as there is conflict.
SECTION 11.
This ordinance shall become effective immediately upon its pass—
age,
