O-368-72 ORDINANCE NO. 368 ORDINANCE AMENDING CHAPTER 14 , MIAMI SHORES VILLAGE CODE , PROVIDING FOR THE ELEMENTS OF THE CRIME OF DISTURBING THE PEACE . WHEREAS , an efficient and up-to-date Code of Ordinances , Miami Shores Village, Florida, requires the continuing analysis of statutory and case law throughout Florida and the rest of the United States and periodic revision so as not to conflict with such law; and WHEREAS , section 14-25 of the Code of Ordinances , Miami Shores Village, is based upon section 877 . 03 of the Florida Statutes; and WHEREAS , section 877 .03 of the Florida Statutes has been recently declared unconstitutional; and WHEREAS , the health, safety, welfare and morals of the people of Miami Shores Village, Florida, can not be fully protected without the existence of an ordinance prohibiting certain violent and menacing conduct or conduct that tends to provoke the same. NOW, THEREFORE , BE IT ENACTED BY MIAMI SHORES VILLAGE , FLORIDA, PURSUANT TO CHAPTER 1 OF THE CODE OF ORDINANCES, MImI SHORES VILLAGE, FLORIDA: That section 14-25 of the Code of Ordinances , Miami Shores Village, Florida, is hereby amended to read as follows : "Sec. 14-25 . Disturbing the peace. It shall be unlawful to willfully disturb the peace of other persons by violent and menacing conduct or conduct which tends to provoke menacing and violent conduct or by language tending to provoke an immediate breach of the peace; or by assaulting, striking or fighting any person; or for any person to permit such conduct in or upon any premises owned or possessed by him and which is under such person' s management or control so that the peace of other persons is dis- turbed thereby. Any person violating any provision of this section, upon conviction thereof , shall be guilty of disturbing the peace. " That in all other respects said ordinance is unaffected by this amendment.
