O-343-69 ORDINANCE NO. AN ORDINANCE AMENDING AND REENACTING THE PROVISIONS OF ORDINANCE No. 287 OF MIAMI SHORES VILLAGE , ADOPTING THE SOUTH FLORIDA BUILDING CODE AS THE BUILDING CODE OF MIAMI SHORES VILLAGE AND FOR OTHER PURPOSES. BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA: THAT ORDINANCE NO. 237 OF MIAMI SHORES VILLAGE BE AMENDED AND REENACTED SO THAT THE SAME SHALL READ AS FOLLOWS : SECTION 1. ADOPTION � OF BUILDING, PLUMBING, ELECTRICAL AND RELATED TECHNICAL CODES. The document marked, designated, and known as the "South Florida Building Code, " which is made a part hereof by reference, is hereby adopted as a minimum standard for the purposes expressed therein and shall be known as the "Building Code of Miami Shores Village, " and this document shall be as.-fully effective as though every word, phrase, sentence, or section of the South Florida Building Code were fully incorporated herein, except as modified or added to in sections of this ordinance which follow. SECTION 2. AUTHORITY. Wherever the terms "Building Official, " "Plumbing Inspe ctor, " "Electrical Inspector, " "jurisdiction, " "Regulatory authority, " or similar terms shall appear, they shall refer to the properly designated inspectors or assistant inspectors of the Building Department of Miami Shores Village, and to the authority and jurisdiction of Miami Shores Village and its officials and employees. SECTION 3. QUALIFICATIONS OF INSPECTORS AND PERS0.=EL. .The qualifications of the Building Inspector, Plumbing Inspector, and Electrical Inspector, and other personnel of the Building Department, shall be established by the Village Manager. SECTION 4. APPLICATION FOR BUILDING PERMITS. No person shall erect or construct or proceed with the erection or oncsturction of any building or structure, now add-- to, enlarge, move, improve, alfter, convert, extend, or demolish any building or structure, or any group of buildings and/or structures under one or joint ownership whether on�.one or more lots or tract of land; or cause the same to be donem where the cost of work is 11-vienty-five Dollars ($25.00) or more in value; and on any remodeling or alteration job of any value, without first obtaining a buildingi3ennit therefor from the Building Department. SECTION 5. BUILDING PERMIT FEES. The office of the Building Department of Miami Shores village, shall charge and collect for building permits at the following rates, to wit:- A. Double Fees: When work for which a permit is required is commenced prior to the obtaining of a permit, the fees, as specified herein, may be doubled, but in no event shall such doubled fee be less than Ten Dollars ($10.00) . The payment of such double fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The double fee requirement shall be applicable to all Divisions of the Building Department. MINIMUM FEE . . . . . . . . . . . . . . . . . . . .$10-00 B. When extra inspection trips are necessary due to (1) wrong address being gLven on call for inspection (2) prior rejection of work due to faulty construction (3) work not being ready for inspection at time specified, (4) failure to call for final or other inspections, (5) required corrections not being made or completed at time specified, a fee of Five Dollars -.($5.00) for each reinspection may be charged. . . . . . . . . The payment of reinspection fees may be required before any further permits will be issued to the person or firm owning same, and further inspections may be re fused and to ther-erson or firm owing same, and _2- further inspections may be refused until payment of reinspection fees have been made . . . . . . . Reinspection of existing buildings by all Divisions to determine compliance with the South Florida Building Code, but not annual inspections as required by 305.1 (d) . . . . . . . �5.00 C. REFUNDS, TTME LIMITATION, REVOCATION, ETC. The fees charged pursuant to this ordinance provided the same are for a permit required by Section 301.1 of the South Florida Building Code, may be refunded by the Director of the Building & Zoning Department, subject to the following: (1) No refund shall be made where any work has conmanced except where duplicate permits a-re issued for the same work, in which case a refund in accordance with item 4 may be granted to the prior issued permit holder providhg the duplicate permits were issued within ninety (90) days of each other and request for refund is received within ninety (90) days of the issuance of the latter permit. (2) No refunds shall be made where permit has become void as provided by Paragraph 304.3 (a') of the South Florida Building Code. (3) No refunds shall be made on permit fees of Four Dollars ($4.00) or less (4) Refunds on permits or any item thereon Vaere fees are over Four Dollars ($4.00) will be refundable on a basis of eightypercent (80%) of the balance over Four Dollars ($4.00) , such refunds to be made to the closest dollar. (5) Full refunds may be granted to a permit holder whose permit is cancelled by owner authorization where work has comnaenced and such owner selected a second contractor to complete the work. The second contractor shall pay a full fee to complete the work unless the first contractor waives his oppor- tunity to a refund in writing, in which case, the second cont-rac_­or J.F. c:�nt.il-. ZONING ORDINANCE. Before any permit is issued, all provisions o.-L' the Miami Shores Village zoning ordinance No. 270, and any amendnaents thereto shall be complied with, and the provisions of the Building Code shall not be construed to repeal, supersede, or modify any part of the said Zoning Ordinance No. 270 or amendments thereto. SECTION 7. PEMLTIES. Any person convicted for violating any of this ordinance shall, upon conviction thereof in a municipal court of Miami Shores village, be sentenced to pay a fine not exceeding the sum of Five Hundred Dollars ($500.00) or serve a term not to exceed sixty days in the Village jail, or both such fine and sentence in the discretion of the Municipal Judge. SECTION 8. SEPARATE OFFENSES. Each day's violation of any of the terms oi-'-- this ordinance shall be deemed and considered and is hereby specially declared to be a separate and distinct violation of the terms of this ordinance and puAishable as such. -16- SECTION 9. SEPARABILITY. In the event that any portion of this ordinance shall be held to be void, inconsistent or of no effect by a court of competent jurisdiction, such holding shall in no wise affect or disturb the remaining portions of this ordinance. SECTION 10., All ordinances in conflict or inconsistent herewith are hereby repealed insofar as there is conflict. SECTION 11. This ordinance shall become effective immediately upon its passage.
