O-320-65 ORDINANCE NO. 320
AN ORDINANCE AUTHORIZING THE POLICE
OFFICERS OF MIAMI SHORES VILLAGE TO
STOP AND SEARCH PERSONS UNDER CERTAIN
CIRCUMSTANCES.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
Section 1. Any police officer of Miami Shores Village,
when he has probable cause for believing that any person is in the act
of committing, has committed or is about to commit any offense against
the laws of Miami Shores Village, Dade County or the State of Florida,
may stop any such person and require that he give his name, address
and an explanation of his actions to such officer.
Section 2. When a police officer has stopped such a person
for questioning as herein provided for and has reasonable cause for
suspecting that such officer is in danger of life or limb, he may make
such examination of the person so stopped as is reasonably necessary
to determine whether he is armed with a dangerous weapon. If the
officer finds such a weapon or an� other thing, the possession of which may
constitute a crime, he may take and keep it until the completion of the
questioning so to be conducted at which time, if it be lawfully possessed,
it shall be returned to such person; otherwise, the police officer shall
retain it in his possession and arrest the person so examined.
Section 3. Any person, when called upon to account for
himself as herein provided, who refuses so to do, or who resisted an
officer in the enforcement of the duties hereby conferred upon him,
shall be imprisoned for not more than thirty days, or fined not more
than $100. 00, or both, in the discretion of the Court.
Section 4. This ordinance shall take effect immediately
upon its adoption.
