AN ORDINANCE GOVERNING THE PUBLI-
CATION OF LITERATURE RELATING TO
CANDIDATES FOR ELECTION TO MUNICIPAL
OFFICE.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
Section 1. From and after the passage of this ordinance it
shall be unlawful for any person for a period of seven days preceding the
day of any municipal election to publish or circulate, or cause to be pub-
lished or circulated, any charge or attack against any candidate in such
election, unless such charge or attack has been personally served upon
such candidate at least fourteen days prior to the date of election; pro-
vided that it shall not be considered a violation of this ordinance for any
person to answer a charge against or attack upon such person where the
answer contains purely defensive matter and does not make affirmative
courter-charges or attacks.
Section Z. From and after the passage of this ordinance it
shall be unlawful for any person to distribute any political pamphlets, cards
or literature of any kind or solicit votes or approach any elector in an
attempt to solicit votes within 100 yards of any municipal polling place.
Section 3. All political advertisements and all campaign liter-
ature published or circulated prior to or on the day of any such municipal
election shall be signed by the author thereof and if the same is being
published and circulated by a club or committee, then it shall be signed
by the Chairman or Secretary of such club or committee and if such
literature is in circular form it shall have printed upon it the name of
the printer or publisher.
Section 4. The term "political" advertisement as herein
used means an expression by any mass media whether radio, television,
newspaper periodicals, direct mail, display or by means other than the
spoken word in direct conversation, which shall, by attracting public
attention, transmit any idea furthering or opposing the candidacy for
public office of any person.
Section 5. Violation of this ordinance shall be punishable by
a fine not to exceed $500. 00, or imprisonment not to exceed thirty days,
or both, in the discretion of the Couxt.
Section 6. This ordinance shall take effect immediately upon
its passage.
