O-295-60 ORDINANCE NO. 295 AN ORDINANCE PROVIDING FOR THE LICENSING OF PERSONS ENGAGED IN THE BUSINESS OF OPERATING PRIVATE PATROL SERVICES AND PROVIDING FOR THE REGU- LATION THEREOF. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. From and after the passage of this ordinance, it shall be unlawful for any person to engage in the business of conducting a private patrol service within the limits of the Village, as such service is herein defined, without first having complied with all of the provisions of this ordin- ance, and no operator as herein defined shall enter into a contract for the rendition of the services hereinafter referred to, or perform any such services without having first paid the fee and secured a permit from Miami Shores Village, as hereinafter provided for. Section 2. The term "private patrol service" as herein used, means a service by which a person, firm or corporation renders services as watchman for a resident of the Village under an agreement between them, by which the person rendering the service shall undertake, for a consideration, to maintain a watch and conduct regular inspection of the premises of the persons so employing him. * The term "operator" or "licensee" as used hereafter in this ordinance, shall refer to any person, firm or corporation engaged in the rendition of such service. Section 3. Before any permit shall be issued by Miami Shores Village to a p�rson seeking to qualify under the terms of this ordinance, such. person shall make application for a permit to the Village Manager, on a form to be approved by such Manager, which shall require the applicant to furnish certain information more particularly to be set forth therein, and to do the other acts provided for by this ordinance. Among the requirements which the Village Manager may impose upon such application may be the following: (a) The application shall set forth the name of the applicant. If the applicant be an individual, it shall give such �X' reasonable history concerning his activities as may be required. If it be a partnership, the application shall give the same inform- atiou relative to all members of the partnership. If it be a corporation, the application shall give the same information w ith respect to all of the officers and directors of the corporation and shall, in the discretion of the Village Manager, also name the stockholders. The application shall likewise give the names of all persons who are to perform services as watchmen under said agreement. (b) The application shall be accompanied by photographs of all persons connected with the applicant who are to perform any work in Miami Shorea Village. Section 4. Before any such application shall be granted, all persons connected with the applicant, efther as owner, owners, officers, directors or employees performing services in Miami Shores Village shall be fingerprinted by the Police Department of said Village. The records of such fingerprints shall be submitted for examination to the Federal Bureau of Investigation to ascertain whether or not such persons have been convicted of any felony or misdemeanor, in which event the permit shall not include the person having such record. Section 5. No permit shall be granted to any person to perform any services under such permit, who has been refused a permit by Dade County to carry firearms and if such permit has been granted a copy of the same shall be filed with the Police Department. Section 6. From time to time, such operator shall file with the Police Department a complete list containing the names and addresses of all persons living in Miami Shores Village who have employed the services of such operator and such list shall be kept current by the elimination of persons who have terminated such services and by the addition of those who have procured the same, such additions and deletions to the list to be filed with the Police Department not later than the tenth day of each month following the granting of the permit. Section 7. The Village Manager shall have fun power and authority, upon making of complaints concerning the performance of services by such operator to inquire into the same, upon notice to the operator, and if the operator be found guilty of any act done in violation of this ordinance, the Village Manager shall forthwith revoke the permit so issued and there- upon the right of the operator to render such services in Miami Shores Village shall cease. . Section 8. The applicant at the time of filing his application with the Village Manager shall pay a. fee of $10. 00 to defray the reasonable cost of making the investigation herein required, and at the time that the application is granted, shall pay an additional fee of $37. 50 for an occupational license for one patrolman or agent and $5. 00 for each additional patrolman or agent for the privilege of doing business in said Village by said applicant. Section 9. Violation of any provision of this ordinance shall subject the person so convicted of the payment of a. fine of not more than $500. 00, or imprisonment in the Village Jail of not more than sixty days, or both in the discretion of the Court.
