O-281-57 ORDINANCE NO. 281 AN ORDINANCE TO BE KNOWN AS THE OCCUPATIONAL LICENSE ORDINANCE OF MIAMI SHORES VILLAGE; GIVING DEFINITIONS OF CERTAIN TERMS; ADOPTING LAWS, RULES AND REGULATIONS CONNECTED WITH, INCIDENT TO AND GOVERNING OCCUPATIONAL LICENSES; FIXING LICENSE FEES FOR VARIOUS BUSINESSES, OCCUPATIONS AND PROFESSIONS; FIXING LICENSE FEES FOR BUSINESSES, OCCUPATIONS AND PROFESSIONS NOT SPECIFICALLY COVERED; REPEALING ALL ORDINANCES OR PARTS OF ORDIN- ANCES IN CONFLICT WITH THIS ORDINANCE. BE IT ORDAINED BY MIAMI SHORES VILLAGE, FLORIDA: SECTION 1. LICENSE REQUIRED. No person shall, within the limits of Miami Shores Village, engage in or manage any business, occupation or profession without first having paid the amount of license tax required hereby and without first having obtained a Village occupational license therefor issued for and applying to the current occupational license year, or fractional part thereof, during which such business, occupation or profession is commenced, carried on or engaged in. Such, occupational license shall be applied for and obtained before the commencement of any such business, occupation or profession, and annually thereafter on or before October Ist of each year as long as such business, occupation or profession is carried on. For the purposes of this ordin- ance, any person holding himself out to the public, by sign, printed matter or otherwise, as being engaged in business or as offering services or property to the public for a consideration, shall be considered as engaging in business and shall be liable for an occupational license tax therefor, according to the classifi- cation of the business so held out or advertised, as set forth herein. 0 SECTION 2. APPLICATION FOR LICENSE. Prior to the issuance of any occupational license a written application therefor, signed by an officer, partner or owner of the proposed business, occupation or profession, shall be filed with the Village Clerk, upon forms prescribed by him. In such application, the applicant shall set forth the name of the owner (if a firm, the names of all members of the firm; if a corporation, the names of all officers of the corpora- tion); the location of the business, the full nature of the business; where the license tax is based thereon, the value of stock carried or the number of seats, employees, gasoline pumps, rooms, or vehicles, etc. , as the case may be; and such other pertinent in-formation as may be prescribed by the Village Clerk. All licenses shall be applied for and issued in the real name of the applicant; in cases where the applicant does or will do business under a fictitious, trade or firm name, the application, and the license if issued, shall show the real name as well as the fictitious, trade or firm name of the applicant. The Village Clerk may waive the requirement of a written application in all cases of renewals of existing licenses, but shall require, before issuing any renewal license, the furnishing of all necessary information pertinent to the establishment of the proper license tax or fee for such license. SECTION 3. VALUE OF STOCK CARRIED. Whenever in this ordinance a license tax is d upon or determinable by the "value of stock carried", the value of stock carried shall be the cost value of all stock in trade and merchandise on hand as of the close of the fiscal year of the licensee next preceding the start of the license period in question. Where the license is not a renewal license or the licensee has not completed one fiscal year, then the value of stock carried shall. be the cost value of all stock in trade and merchandise on hand as of the date of commencement of business. The true value of stock carried, as above defined, shall. be stated by the applicant in his application for a license or for a renewal of license. In the event an applicant for a license fails or re- fuses to state or set forth the value of stock carried, as above defined, or sets -I- forth such value inaccurately, the Clerk shall fix and determine such value from any information in his possession, and the value so fixed shall be used to deter- mine the amount of license tax due the Village. SECTION 4. FALSE STATEMENTS IN APPLICATION. Any license obtained under the provisions of this ordinance upon a misrepresentation of a material fact shall be deemed null and void, and the licensee who has thereafter engaged in any business under such license shall be subject to prosecution for doing business without a license, to the same effect and degree as though no such license had ever been issued. SECTION 5. DETERMINATION OF CLASSIFICATION. In the event of a disagreement be!_,��een Tipli—can-t and the 'V—illage—on the question of proper classification of any business, -,-,ccupation or profession for license purposes, the Village Clerk shall decide the proper classification, with the right, in the applicant, to appeal from such decision to the Village Council, whose decisian upon. the point shall be final. SECTION 6. TERM AND DURATION OF LICENSE. Except as other- wise provided, licenses shall expire on the thirtieth day of September of each year. No license shall be issued for more than one year. SECTION 7. LICENSE FOR FRACTIONAL PART OF ONE YEAR. Unless otherwise provided, for each license obtained between October first and April first the full tax for one year shall be paid, and for each license obtained from April. first to September thirtieth, one-half the full tax for one year shall be paid. SECTION 8 LICENSE TO APPLY TO ONE PLACE OF BUSINESS, All licenses provided for herein shall be issued for and apply to only one loca- tion or place of business. SECTION 9. EXEMPTIONS. Exemption fro-in the payment of the license tax set forth herein shall be allowed in such cases as are provided for in this ordinance, and in the following cases as provided for by the 'Laws of the State of Florida: (a) Disabled veterans of.the Spanish American War; World War L or World War II, and widows of such deceased veterans (exempted up to $50. 00 annually); (b) Confirmed cripples; deaf and dumb persons; invalids physically incapable of manual labor; widows with minor dependents; and persons 65 years of age or older; (c) Growers of farm and grove products. SECTION 10. BILLS OR NOTICES FOR LICENSE TAX. It is hereby declared to be unnecessary for t e Village to send out bills or notices to persons engaged in business in the Village with respect to the payment or non-payment of license taxes. SECTION 11. POSTING OF LICENSE. Every license shall be posted in a conspicuous place in the place of business for which it is issued and the holder of such license shall exhibit same to any inspector or Police Officer upon being requested so to do. SECTION 12 TRANSFER OF LICENSE - LOCATION. Licenses may be transferred from one location to another, prov-ided_._Ta_�—that the licenses are presented to the Village Clerk for the approval of such transfer; and (b) that the licensee shall pay for such transfer a fee in the amount of $1. 00. SECTION 13. TRANSFER OF LICENSE - CHANGE OF OWNERSHIP. Licenses issued by the Village may be �r_� erred as to ownership with the -2- approval of the Village Clerk (except in the case of al.chol.ic beverage licenses, which shall require approval of the Village Manager); subject, however, to the followmg conditions. A. The seller of the busi,ness shall present the license to the Village Clerk with an endorsement on the reverse side thereof, assigning all right, title and interest to the purchaser-, B. The purchaser shall file an application for license, and shall qualify in all respects as provided by .11aw and by the ordinances of the Village as an applicant for a license, as if he had applied for the license in the first instance. C. A fee shall be paid by the new business entity, in the amount of $1. 00 to cover such transfer. D. Where the licensee has been exernpted from payment of all or any part of the license tax therefor, any such license shall not be transferable under this section. SECTION 14. REPLACING LOST OR DESTROYED LICENSES. For the purpose of replacing any mutilated, destroyed or lost license certificate receipt relating to any occupational license granted by the Village, the Clerk is hereby authorized and empowered to cause to be executed and delivered an appropriate duplicate license certificate or receipt, upon the submission of evidence satisfactory to said Clerk that the original certificate or receipt was mutilated, destroyed or lost, and upon the payment, to the Village by said holder of the sum of ($1. 00) one dollar for each such duplicate license certificate executed. SECTION1. 5. LEASE DEPARTMENT. Every person operating what is commonly knc;,-�v7n—�`T�—Lea�`se in—an—y store shall .-, ay a license for the operation of each department so leased according to the proper classification of the business or occupation as set forth therein. SECTION 16. TERMINATION OF LICENSE ON NOTICE OF BANKRUPT C�7i—. -Vh—en--any person engaged in merchantile or other business in the Village shall. make an assignment for the benefit of creditors, or when any such person shall be adjudicated a voluntary or an. involuntary bankrupt or declared insolvent, any license theretofore issued, authorizing such person to do business in the Village, shall immediately be terminated and shall, upon such assignment for the benefit of creditors or upon such adjudication in bankruptcy, immediately become null and void. SECTION 17. REVOCATION FOR VIOLATION OF ORDINANCES. The license of any person for the operation of any business may be revoked by the Council at any time, upon notice and bearing for violation of any ordinance of the Village or law of the State of Florida pertaining to, regulating or licensing such business, or for any other good and sufficient reason; provided, however, that: this section shall not affect the power of the municipal court to revoke certain licenses where such revocation is specifically provided for by ordinance. SECTION 18. REGULATORY ORDINANCES REMAIN IN EFFECT. Unless otherwise herein repeaied or specifically excepted, changed or differentiated, all qualifying or regulatory ord-irances of the Village applicable to or affecting any of the businesses, operations, occupations or classifications covered by this ordinance shall be and remain in full force and effect. SECTION 19. PROSECUTION AND RIGHTS UNDER PREVIOUS ORDINANCE�—. -ffe—iti�e—rtlie fact of th-i--adoptio—nof this ordii�a­nce nor the fact of its superseding or repealin.g any portion of any other ordinance of Miami Shores Village, shall in any way be construed to z1fect or waive prosecution for violation of any other ordinances which may have been consummated prior to the effective date hereof, nor shall they be construed as a waiver of any license or of any penal provision applicable .. 3 - to any such violation; nor shall they be construed to affect the validity of any portion of the cash deposit bond or insurance required by any ordinance to be posted, filed or deposited and all rights and obligations thereto appertaining shall continue in full force and effect. SECTION 20. "PERSON" DEFINED. The word "person" wherever used in this ordinance shall mean either an individual, firm, partnership, corpGration , Association, executor, administrator, trustee or other legal entity, whether singular or plural, masculine or feminine, as the context may require. SECTION 21. ZONING AND BUILDING REGULATIONS. Nolicense shall be issued hereunder for any business, occupation or profession until the location of such business shall have first been approved by the Building Department of the Village as to its compliance with zoning and other regulatory ordinances of the Village. SECTION 22. REGULATIONS. The Village Clerk may make such rules and regulations, not inconsistent with this ordinance, as may be necessary or proper for the enforcement of the provisions hereof. SECTION 23. PEDDLING OR DOOR TO DOOR SOLICITING. The sale of goods, wares and merchandise by any person or persons as a peddler -dr solicitor is permitted only under the conditions provided by Ordinance No. 206. The sale of the natural products of the soil by the farmer by whom they are raised is not considered to be peddling. SCHEDULE OF LICENSE TAXES SECTION 24. No license shall be issued to any person or corporation within 2 years after such person or any officer or director of such corporation, has been convicted of a violation of the State beverage law, or to any person or corporation whose license under such beverage lawhas been revoked. Applicants for such licenses, or for transfers of such licenses, shall, furnish the Village Clerk at time of application with a credit report from a reputable credit bureau in Dade County, and with letters of character reference from at least three reputable residents of Miami Shores Village or Dade County before such license issuance or transfer shall be approved, and every applicant for a license or a transfer of a license shal I be fingerprinted by the Police Department of Miami Shores Village; no license or transfer of license to any appD.cant therefor shall be issued or made, without special order of the Village Council, until and after a criminal record search has been received from the Federal Bureau of Investigation upon such fingerprints, and - 5 - any license issued or transfer of license made before such record is received shall be null and void if the record, when received, shows the applicant to be not qualified for such license. LICENSE FEE A DEBT. The amount of any license tax and penalty imposed by the provisij—ns �T t!7is ordinance are hereby declared to be a debt due to Miami Shores Village and any person carrying on any business with- out first having procured a license from the Village to do so, shall be liable to the Village for the amount of such license tax recoverable in any court of competent jurisdiction. SECTION 26. PENALTIES. Any person convicted for violating any of the terms of this ordinance shall, upon conviction thereof in a municipal court of Miami Shores Village, be sentenced to pay a fine not exceeding the sum of Five Hundred Dollars ($500. 00) or serve a term not to exceed sixty days in jail, or both such fine and sentence, in the discretion of the Municipal Judge. SECTION 27. ADDITIONAL PENALTY FOR DELINQUENCIES. Whenever any license tax provided by this ordinance shall remain unpaid after its due date for a period of ninety days, there shall be added to, and become a part of, the license tax, a penalty of ten percent of the original amount of such license tax. SECTION 28. SEPARABILITY. In the event that any portion of this ordinance shall be held to be void, inconsistent or of no effect by a court of competent jurisdiction, such holding shall in no wise effect or distrub the remaining portions of this ordinance. SECTION 29. REPEALING CLAUSE. All ordinances or parts of ordinances in conflict or inconsistent herewith are hereby repealed, insofar as there is conflict.
