O-263-55 ORDINANCE NO. z63 AN ORDINANCE FOR THE ESTABLISHMENT OF PENSION AND INSURANCE FUNDS BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. There is hereby established pursuant to the authority granted Miami Shores Village, by Chapter 27740, Laws of Florida, 1951, a fund to be know as the relief or pension fund which shall consist of con- tributions made thereto as hereinafter provided, and which shall be used for the payment of relief or pension of persons in the employ of said Village. Section 2. If, at the election of the freeholders of this Village to be held on April 12, 1955, a majority of the persons participating in said election as provide.d for by law, shall vote in favor of the adoption of this ordinance, the Village Manager shall forthwith submit to th� Council a plan which shall provide for the payment of pensions to persons in the employ of this Village, and for the making of contributions of public monies to such fund on terms and conditions to be set forth in said plan, together with his retommendations thereon. Section 3. If at the said election a majority of the freeholders so participating, shall vote in favor of the adoption of this ordinance insofar as the same authorizes this Council to make contracts of insurance with insur- ance companies authorized to do business in the State of Florida, insuring the employees of this Village or any class or classes thereof against loss of life, health or accident or for the payment to such employees of annuties or pensions, the said Village Manager shall forthwith present to the Council a plan effectuating said ordinance, together with his recommendations thereon. Section 4. The Council after considering such recommendations shall adopt an ordinance putting either or both of said proposed plans into effect with such alteration thereof as it may deem proper to the end that adequate plans for the relief or pension of persons in the employ of said Village, and adequate plans for insuring the employees of said Village against loss of life, health or accident or for the payment of annuities or pensions or both such pension or insurance plans shall be adopted as con- templated by Chapter Z7740, Laws of Florida, 1951. Section 5. Regardless of the kind or number of plans that may be adopted by the Council, it shall not be authorized except by an amendment to this ordinance to be submitted to the freeholders of this Village as provided by said Chapter Z7740, Laws of Florida, 1951, to levy taxes in any taxable year on the real and personal property in said Village, in a sum exceeding one mill on the dollar of the assessed valuation of said property for the purpose of paying the cost of the municipality's con- tribution to either or both of said relief or pension plan or said insurance plan, nor shall other monies of said Village be contributed to such plans if the result thereof shall be to increase the taxes collected by said Village against the real and personal property of the inhabitants thereof in any one year in a sum in excess of said one mill. Section 6. If this ordinance shall be approved as provided for in Sections Z. and 3. , the fund established in Section 1. shall be provided for with such safeguards with respect to contributions ther' eto and with- drawals therefrom which the Council may from time to time provide.
