O-249-53 ORDINANCE NO. Z49 AN ORDINANCE REQUIRING THAT THE OWNERS OF ANY PROPERTY SITUATED WITHIN THE LIMITS OF MIAMI SHORES VILLAGE AND UPON WHICH THERE IS CONSTRUCTED A SWIMMING POOL SHALL FENCE THE SAME, AND PROVID- ING FOR A TIME WITHIN WHICH SUCH PERSONS ARE REQUIRED TO COMPLY WITH THIS ORDIN- ANCE, AND FIXING A PENALTY FOR VIOLATION THEREOF. WHEREAS, several children have recently drowned in swimming pools in Dade County, Florida, and the maintenance of said swimming pools constitutes an attractive nuisance, NOW, THEREFORE, BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. That from and after the effective date of this ordinance it shall be unlawful for any owner of any property situated within the limits of Miami Shores Village to construct or maintain a swimming pool that is not fenced, or the yard area fenced, with a fence of a minimum height of four feet. Section 2. That prior to the erection of any fence surround- ing any swimming pool now constructed, or to be constructed, the owner shall submit to the Planning Board of Miami Shores Village a plan, sketch or drawing of the proposed fence and receive the approval thereof by the Planning Board. If any such owner shall feel aggrieved by the action of the Planning Board, he shall have the right to appeal to the Village Council, as in the manner provided for by the Zoning Ordinance of said Village. Section 3. That owners of property upon which there is already erected a swimming pool which is not fenced shall have ninety (90) days within which to comply with the provisions of this ordinance. The ninety day period shall be told from the date notice is mailed to said owner. Section 4. This ordinance shall become effective immediately upon its passage. Section 5. Violation of this ordinance shall be punish- able by a fine not to exceed Five Hundred Dollars($500. 00) or by imprisonment for a term not to exceed sixty (60) days, or by both such fine or imprisonment, in the discretion of the Court.
