AN ORDINANCE TO AMEND ORDINANCE
NO. 92 BY CHANGING THE USE
CLASSIFICATION ON LOTS 1 through
5 inclusive, BLOCK 21.4 MIP24I
SHORES SECTION 1
WHEREAS, by a decree of the Circuit Court of Dade
County, Florida, in the suit lately pending therein wherein
Bessemer Properties was plaintiff and Miami Shores Village
was defendant ., it was decreed that certain property in the
said Village described as
LotS13 through 17 inclusive,
Block 28, MIAMI SHORES SECTION
1. according to Plat Book 10,
Page 70, of the Public Records
of Dade County, Florida
be placed in such a zone to permit the said property to be
used for commercial purposes , and
WHEREAS, said decree was thereafter affirmed by the
Supreme Court of Florida in a case entitled Miami Shores
Village vs. Bessemer Properties ., 54 So. (2) 108, and
WHEREAS, the property hereinafter described lies
directly across the street from, the property involved in said
suit and is subject to the same conditions that prevailed in
said suit ., and
WHEREAS, since the affirmance of the aforesaid de-
cree the said property has been assessed by Miami Shores
Village as business property,
NOWS THEREFORE , BE IT ORDAINED BY MIAMI SHORES
VILLAGE THE FOLLOWING:
Section 1. That Ordinance No. 92, and the map
accompanying the same , be amended so that Lots 1 through 5.
inclusive , of Block 21., MIAMI SHORES SECTION 1., shall be put
in Zone B-1 and shall be used for the purposes as set forth
in said zone and as defined in said ordinance.
