O-244-53 ORDINANCE NO. Z44_ AN ORDINANCE DEFINING CERTAIN MIS- DEMEANORS AND PROVIDING FOR THE PUNISHMENT THEREOF. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1 . STATE MISDEMEANORS. It shall be unlawful to coEilit , within the limits of the Village, any act which is or shall be recognized by the laws of the State of Florida as a misdemeanor, and the commission of such act is hereby forbidden. SECTION 2. DISTURBING THE PEACE. It shall be unlawful in the Villag�7to wilfully disturb the peace of other persons by violent , tumultuous or offensive conduct or carriage; or by profane , obscene or offensive language, calculated to provoke a breach of the peace; or by assaulting, striking or fighting any person, or for any person to permit such conduct in or upon any premises owned or possessed by him and which is under such person4s management or control , so that other persons are disturbed thereby; any person violating any of the provisions of this section, upon conviction thereof, shall be guilty of disturbing the peace . SECTION 3. DISORDERLY CONDUCT, It shall be unlawful in thF­VV=E`g6'_for any person to make, aid, countenance or assist in making any improper noise , riot , disturbance or breach of the peace; or to collect in a group or crowd for any unlawful purp-ose to the annoyance or disturbance of other persons ; or to be idle or dissolute and go about begging; or to engage in any unlawful game or enterprise; or to be found in any house of ill-fame or gambling house; or to lodge in or to be found in or about any unoccupied buildings , sheds , garages or outhouses or lodging in the open air without being able to give a good account of himself; or to wilfully assault any other person or to engage, aid or abet in any fight, quarrel or other disturbance; or to stand, loiter or stroll about in any place in said Village , waiting or seeking to obtain money or other valuable thing from others by trick or fraud or to aid or assist therein; or to engage in any fraudulent scheme , device or trick to obtain money or other valuable thing in any place in said Village or to aid or abet or in any manner be concerned therein; or to tout , rope or steer for any gambling game; or to loiter in any hotel , street , park, unoccupied premises , business house or wander about the streets , either by day or night without any known lawful means of support or without being able to give a satis- factory account of himself; or to have or carry any pistol, knife , dirk, knuckles or other dangerous weapon concealed on or about the person; or to be known to the police of this Village as a thief, burglar, pick-pocket , robber or confidence man, or law violator of this state or any other state of the United States of America either by admission, conviction or otherwise and to loiter, prowl or lounge around any bus terminal ., banking institution, school house, play ground, railroad depot , place of public amuse- ment , hotel, store, shop, street , private dwelling, house , place of public assemblage , beer or wine tavern and unable to give a reasonable excuse for being so found; any person violating any of the provisions of this section, upon conviction thereof, shall be guilty of disorderly conduct . SECTION 4. ENGAGING IN GAMES OF CHANCE. It shall be unlawful for any person in the Village to play or engage in any game of cards ., dice, roulette, faro, bolita or any other game of ( 1 ) chance , whether related to the above enumerated games or not , by any device whatsoever, for money or other thing of' value . SECTION 5. GAMING. It shall be unlawful for any person in the Village to stake , bet or wager any money or other thing of value upon the result of any trial or contest of skill , speed or powers of endurance of man or beast and whoever receives in any manner whatsoever any money or other thing of value staked, bet or wagered, or offered for the purpose of being staked, bet or wagered by or for any other person ,upon any such result , or whoever knowingly becomes the custodian or depository of any money or other thing of value so staked, bet or wagered upon any such result , or whoever aids or assists or abets in any manner any of such acts all of which are hereby forbidden, upon conviction thereof, shall be guilty of gaming. SECTION 6. KEEPING GAMBLING HOUSE. It shall be unlawful in �Ehe Vill—age for any person to set up or keep any gambling device at which any game of chance shall be played for money or to keep a place for or allow gambling to be carried on in or about his premises , and any person guilty of violating any provision of this section upon conviction thereof, shall be 'guilty of keeping a gambling house . SECTION 7. BOOKMAKING. It shall be unlawful in the Village for any person to accept or transmit , either for himself or others , any wager upon horse or dog racing, or for a person either for himself or for any person, knowingly to suffer or permit the use of premises owned, controlled or used by him to accept or transmit , either for himself or others , any wager upon horse racing, except where such wager is upon a race held at a race meeting then being conducted at a duly licensed race track in this county, under the supervision of the State Racing Commission,, and where the money for such wager is personally transmitted and paid by the recipient to the proper officials or agents duly authorized to conduct racing pools at such tracks ; any person violating the provisions contained in this section, upon conviction thereof, shall be guilty of bookmaking. SECTION 8. ENGAGING IN OPERATION OF A LOTTERY. It shall be unlawful for any person, in the Village to set up, promote or conduct any lottery for money or for anything of value; or by means of any lottery to dispose of any money or other property of any kind whatsoever; or to conduct any lottery drawings for the distribution of prizes by lot or chance, or to advertise any such scheme or device in any newspaper or by circulars , posters , pamphlets or otherwise; or to sell, or to offer for sale, or to transmit , by mail or otherwise , any lottery tickets , coupons , or share in or fractional part of any lottery tickets , share or coupon, or to attempt , conduct or advertise any lottery scheme or device; or to have in his possession any lottery wheel, implement or device whatsoever for conducting any lottery or scheme for the disposal by lot or chance of anything of value; or to have in his possession any lottery advertisement , circular, poster or pamphlet , or any list of any lottery prizes , gifts or drawings , or to aid or assist in the setting up or conducting of any lottery, either by writing or otherwise; or to be in- terested in., or connected I#W�pny way with disposal or procurement of any lottery ticket , cl share or right to any drawing therein; any person viol any of the provisions of this section, upon conviction thereof, shall be guilty of engaging in the operation of a lottery. SECTION 9. DISORDERLY CONDUCT IN HOUSES. It shall be unlawful for any person to permit persons of disorderly character to assemble in his house within the corporate limits of the Village to the- disturbance of the persons residing in the neighborhood, and any person violating the provisions of this section, upon conviction thereof, shall be guilty of keeping a disorderly house . 2 SECTION 10. CARRYING CONCEALED WEAPONS. It shall be unlawful in the Village for any person, except an officer of the law authorized to make arrests , to carry con- cealed about his person any pistol , dirk, bowie-knife , clasp knife , razor, metallic knuckles , sling shot , or any other deadly weapon, except an ordinary pocket knife , or to carry any fountain pen or other device or instrument designed to discharge , or for the purpose of discharging, tear gas or other injurious gas . SECTION 11 . RESISTING ARREST. It shall be e____1T__Tor any person to resist arrest by unlawful in th Vi age an officer of the Village or to resist any person called by an officei, of the Village to aid in making an arrest . SECTION 12. . . REFUSING TO ASSIST OFFICER. It shall be unlawY_ul _fH_'EH_e_Village for any person to refuse to aid an officer of the Village when called upon by such officer to assist in making an arrest . SECTION 13. INFORMATION CONCERNING INJURY OR DEATH. It shall be unlawful for any doctor, clinic or hospital caring for or administering to any person in the Village who has been wounded by pistol , gunshot wound or other weapon, or who has been adminstered poison to neglect or to refuse to report to the Chief of Police of the Village within two hours after said wounded or poisoned person is first administered to or requests attention. If such wounded or poisoned person does not give satisfactory explanation to the doctor, clinic or hospital of the wound or poison or how said wound or poison was received, the Chief of Police of the Village shall be notified immediately. SECTION 14. Violation of any provision of this ordinance iih 1 be punished by a fine of not exceeding Five Hundred Dollars ($500-00) or imprisonment not exceeding sixty (60) days , or both, in the discretion of the Court . SECTION 15. All laws and parts of laws in conflict herewT-thbe , and the same are hereby repealed. SECTION 16. This ordinance shall take effect immediately upon its passage .
